بعض القصص لا تتسع لها دورة خبرية واحدة. وقضايا حقوق السكن والأراضي والملكية في سوريا هي من هذا النوع؛ إذ تتوزع خيوطها بين النصوص القانونية والمصادر الرسمية والتقارير الميدانية والمنشورات المؤسسية، وقلّما يجمعها مكان واحد بالعمق الذي تستحقه.

لهذا نطلق «طابو أخضر»، أول مجلة سورية متخصصة بحقوق السكن والأراضي والملكية.

وجاء اسم المجلة من لون الوثيقة؛ فالطابو هو الاسم الشائع في سوريا لسند الملكية الرسمي. وترجع إلى أصل تركي-عثماني، وهو مصطلح ارتبط تاريخياً بتسجيل الأراضي وسندات الملكية.

وامتداداً لتغطية «سيريا ريبورت» الطويلة لقضايا السكن والأراضي والملكية، تأتي المجلة بصيغة فصلية موحدة تجمع بين التحليلات، والمقابلات مع الخبراء، وملخصات السياسات، وتوثيق النصوص القانونية والبيانات.

صدر الآن العدد الأول من «طابو أخضر» باللغتين العربية والإنكليزية، ويقدّم لكم:

Introducing Green Tabu

A quarterly journal on housing, land and property rights in Syria

Some stories don’t fit into a news cycle. Housing, land and property rights in Syria are exactly that kind of tale, sprawling across legal texts, official sources, field reporting and institutional publications, and rarely brought together in one place, with the depth they deserve.

That’s why we’re launching Green Tabu, Syria’s first HLP journal.

Named after the colour of the document, tabu is the common term used in Syria for an official title deed. The word comes from the Ottoman Turkish tapu, a term historically associated with land registration and title deeds.

Building on The Syria Report’s longstanding HLP coverage, the Journal moves to a consolidated quarterly format that combines analysis, expert interviews, policy briefs, and legal and data documentation.

The first issue of Green Tabu is out now, in English and Arabic, and takes you inside:

إعادة إعمار جوبر والقابون تطرح نموذج اقتطاع الملكيات وتمويل الشركات

عقدت محافظة دمشق اجتماعاً في مبنى المحافظة في 13 آذار 2026، لمناقشة ملف إعادة الإعمار نتيجة الدمار الواسع الذي طالهما خلال فترة الحرب السورية 2012-2018. وحضر الاجتماع حوالي 30 شخصاً من لجان الأحياء ووجهاء القابون وجوبر بالإضافة إلى حقوقيين ومهندسين. وعَرَضَت المحافظة خلال الاجتماع، مقترح مشروع لما وصفته بإحياء المناطق شرقي العاصمة، بما يشمل جوبر والقابون، وأيضاً باب شرقي الذي لم يحضر ممثلون عنه.

بحسب مراسل سيريا ريبورت، فقد أشار مدير مكتب لجان الأحياء في محافظة دمشق محمد إسماعيل البزري، خلال الاجتماع، إلى وجود توجه رسمي لاستقدام شركات أجنبية تموّل وتنفذ المشروع وبنيته التحتية، مقابل حصولها على نسبة 50 بالمئة من المساحة الكلية لمنطقة المشروع. مساحة المشروع تصل إلى 1100 هكتار، بكلفة تقديرية تقدر بـ21 مليار دولار، ويمكن أن تخلق حوالي 200 ألف فرصة عمل، بحسب برازي. يبدو رقم 21 مليار دولار أميركي الذي قدّره السيد البزري مبالغاً فيه، بالنظر إلى أن البنك الدولي قدّر أن التكلفة الإجمالية لإعادة الإعمار في سوريا تبلغ 216 مليار دولار أميركي. وأضاف البرازي أن الاستعانة بالشركات الأجنبية تعود إلى ضعف إمكانيات القطاع الخاص السوري، وأيضاً عدم قدرة الحكومة على تمويل المشروع. .

مراسل سيريا ريبورت أشار، نقلاً عن بعض من حضروا الاجتماع، إلى أن هذه النسبة المقتطعة، ستتراوح بين 50 بالمئة من مساحة المناطق المنظمة سابقاً، و70 بالمئة من مساحة العشوائيات المبنية على أراض مصنفة زراعية. في المقابل، سيحصل مالكو المساكن المرخصة في المناطق المنظمة على 50 بالمئة من مساحة مساكنهم السابقة، في الأبنية السكنية التي ستنشئها الشركات الأجنبية لهم. بينما في العشوائيات، فسيكون التعويض بنسبة 30 بالمئة من مساحة الأراضي المصنفة زراعية بغض النظر عن الأبنية المخالفة المقامة عليها.

وتجدر الإشارة إلى أن اعتماد نسبة من مساحة المسكن القديم للتعويض على ملاك المساكن المرخصة في المناطق المنظمة، هو أمر معقد حسابياً وأيضاً يصعب تقديره نظراً لحجم الدمار الكبير الذي طال المنطقتين وزوال كثير من الكتل السكنية. كما أن المقترح لم يلحظ حقوق غير المالكين، من المستأجرين والشاغلين السابقين لتلك العقارات. كما أن اعتماد التعويض كنسبة عن مساحة الأرض الزراعية في المناطق العشوائية يتجاهل واقع تلك العشوائيات والعدد الكبير من الأبنية المقامة عليها، وجزء كبير منها مدمر حاليا، وحقوق أصحابها.

بعض الفاعلين من حي القابون أصدروا بياناً في 29 آذار، بعنوان “نحو إعمار عادل يحفظ الأرض والكرامة”، شرحوا فيه موقفهم القانوني والتنظيمي، المرتبط بمقترح إعادة الإعمار. ووصف البيان بعض طروحات المحافظة بأنها قد تؤدي إلى “تهجير قسري بصبغة إدارية”، مؤكداً أن حقوق الملكية الخاصة بعد سقوط نظام الأسد في 8 كانون الأول 2024 هي “حقوق مقدسة ودستورية لا تقبل الانتقاص”. ورفض الموقعون على البيان، ومن بينهم وجهاء ومحامون وأساتذة، نموذج الاستثمار الذي يجري تداوله، معتبرين أنه يقوم على فرض نسب تعويض لا تتجاوز 30% من قيمة الأرض، وهو ما وصفوه بـ”الاستلاب العقاري”، ورأوا فيه مخالفة للمادة 16 من الإعلان الدستوري، واعتداءً على حقوق المالكين.

وطالب الموقعون باعتماد قانون التخطيط وعمران المدن رقم 23 لعام 2015، كإطار قانوني لإعادة تنظيم مناطقهم، مع التأكيد على منح المالكين حق المقاسمة أو تأسيس شركات مساهمة، وحق اختيار المتعهدين، ورفض فرض أي جهات استثمارية عليهم. وينص قانون التخطيط وعمران المدن رقم 23 لعام 2015 على آلية تنظيم تقوم على إعادة توزيع الملكيات ضمن المنطقة التنظيمية، بحيث تُدمج العقارات ضمن كتلة واحدة، ثم يُعاد توزيعها على شكل حصص سهمية تعادل قيمة الملكية الأصلية لكل مالك، بعد اقتطاع نسبة من المساحة لصالح الطرق والمرافق العامة والخدمات. ويُحدد القانون سقفاً للاقتطاع المجاني لا يتجاوز 40 بالمئة من المساحة في مراكز المدن، ويمكن أن يصل إلى نسب أعلى في بعض الحالات المرتبطة بالتوسع العمراني أو المناطق غير المنظمة، وفق ما يرد في المخططات التنظيمية. وفي المقابل، يضمن القانون لأصحاب الحقوق الحصول على مقاسم تنظيمية أو أسهم تنظيمية تعكس القيمة الحقيقية لعقاراتهم قبل التنظيم، وليس فقط مساحتها، مع إمكانية مشاركتهم في تطوير المنطقة عبر شركات مساهمة أو عبر المقاسمة مع المطورين. كما ينص على تشكيل لجان لتقدير القيمة ولحل الخلافات، ويتيح لأصحاب الحقوق الاعتراض على نتائج التقدير أو التوزيع أمام القضاء. ويُلزم القانون الجهة الإدارية بتأمين البنية التحتية الأساسية، مع تحميل المقاسم الناتجة بعض التكاليف وفق نظام محدد، وليس عبر اقتطاع غير منظم من الملكيات. وتُظهر التعليمات التنفيذية للقانون أن جزءاً من الأراضي يُخصص إلزامياً للسكن الشعبي وللمرافق العامة، وأن إعادة التوزيع تتم بناء على مخططات تفصيلية تحدد الطرق والساحات والخدمات، على أن يحصل كل مالك على حصة عادلة قابلة للبناء ضمن المقاسم الجديدة، مع الحفاظ على حقوقه عبر قيود السجل العقاري وإشراف لجان التوزيع الإجباري.

كما يتعامل قانون التخطيط وعمران المدن رقم 23 لعام 2015 صراحة مع العشوائيات “مناطق المخالفات الجماعية” الواقعة ضمن المناطق التنظيمية، إذ يجيز إدخالها في مشاريع التنظيم العمراني وإخضاعها لآلية إعادة التوزيع الإجباري، حتى في حال كانت الأبنية المقامة عليها غير مرخصة. ويعترف القانون بوجود هذه التجمعات كواقع عمراني، ويجيز تثبيت حقوق شاغليها أو مالكيها ضمن عملية التنظيم، بحيث يتم تقدير قيمة الأرض وما عليها من أبنية، ثم تحويل هذه الحقوق إلى حصص سهمية أو مقاسم تنظيمية ضمن المخطط الجديد. وفي هذا السياق، يميز القانون بين الملكية القانونية للأرض، وواقع الإشغال القائم، إذ يسمح بأخذ الأبنية القائمة بعين الاعتبار عند التقدير، حتى وإن كانت مخالفة، عبر لجان تقدير القيمة التي تحدد الحقوق لكل مالك أو شاغل وفق الحالة الفعلية. كما يفرض إشراك أصحاب الحقوق في جداول التوزيع، ويتيح لهم الاعتراض أمام لجان حل الخلافات والقضاء. ويعني ذلك أن وجود بناء غير مرخص لا يؤدي تلقائياً إلى إسقاط الحق، بل إلى إدخاله ضمن عملية تنظيم تعيد إنتاجه بشكل قانوني ضمن المقاسم الجديدة. كما تشير التعليمات التنفيذية للقانون إلى أن مناطق المخالفات الجماعية تُعالج ضمن المخططات التنظيمية من خلال إعادة تخطيطها وتأمين البنى التحتية والخدمات، مع إمكانية تخصيص جزء من الأراضي للسكن الشعبي، ما يعكس توجهاً لدمج هذه المناطق ضمن النسيج العمراني الرسمي.

كما طرح الموقعون على البيان تصوراً عمرانياً بديلاً يقوم على اعتماد الأبراج السكنية عالية الكثافة، بما يتيح منح المالكين حقوقاً طابقية لا تقل عن 55 بالمئة، ويسمح باستيعاب السكان في وحدات حديثة، بدلاً من مخططات يرون أنها تقلص حقوقهم. وأكدوا أن تنفيذ البنية التحتية هو مسؤولية الدولة، معتبراً تحميل المالكين تكاليفها هو بمثابة “ضريبة غير قانونية”، وطالبوا بإصلاح شبكات المياه والصرف الصحي بشكل عاجل، محملين الجهات الرسمية مسؤولية الإهمال الذي أدى إلى أضرار صحية في المنطقة. وحذر الموقعون من أي مفاوضات تُجرى خارج إطار تمثيلهم، معتبرين أن أي اتفاق لا يمر عبر لجنة حقوقية مفوضة هو اتفاق غير ملزم. ودعوا المالكين إلى عدم بيع ممتلكاتهم تحت الضغط، والتشبث بحقوقهم، لضمان العودة إلى مناطقهم الأصلية بشروط تحفظ الملكية والكرامة.

والتقى مراسل سيريا ريبورت بممثلين وسكان من الحيين، الذين اعتبوا أن هذا النموذج ينقل كلفة المشروع إلى المالكين أنفسهم، عبر خصم كلفته من مساحة أبنيتهم المستقبلية. وبما أن كثيراً من هذه المناطق هي عشوائيات مبنية على أرض مصنفة زراعية يمنع البناء عليها، فأصحاب الحقوق فيها سيكونون الأكثر تضرراً. كما أشاروا إلى أن المقترح لم يترافق مع عرض مصورات تنظيمية، ولا مع توضيحات رسمية حول الجهات المنفذة، ولا آليات التعويض والتخمين، ما أثار مخاوف من تحول المشروع من إعادة إعمار إلى إعادة توزيع للملكية لصالح شركات اجنبية.

يقول أبو محمد، أحد أبناء القابون، إن التعويض المقترح سيؤدي إلى خسارة الجزء الأكبر من ممتلكاته وهي عبارة عن بناية صغيرة من عدة شقق مقامة على أرض مصنفة زراعية. ما يعني أن التعويض المحدود سيتوزع على جميع أًصحاب الشقق. ويضيف أن اعتبار هذه الأراضي زراعية يتجاهل واقعها، إذ إنها مأهولة ومبنية منذ سنوات طويلة وتشكل جزءاً أساسياً من النسيج العمراني للمنطقة. ويرى أن هذا التصنيف يؤدي إلى تقليص حقوق المالكين بشكل كبير، ويجعل أي خطة لا تعيد تقييمه غير عادلة. كما أن أي تعديل في نسب التعويض، كرفعها من 30 إلى 50 بالمئة، لا يكون كافياً ما لم يستند إلى تقييم عادل يعكس القيمة الجارية للعقارات.

ويفترض بعض أهالي القابون، ممن التقتهم سيريا ريبورت، إلى أن التعويض يجب أن يستند إلى القيمة الفعلية للعقار، أو أن يوفر بديلاً سكنياً مكافئاً في الموقع نفسه، لا نقل أصحاب الحقوق إلى مناطق بعيدة. كما أن الأضرار الواقعة على مساكنهم كبيرة، ما يتطلب مقاربة شاملة. ويرى بعض هؤلاء أن غياب الشفافية هو المشكلة الأساسية، إذ لم تُعرض تفاصيل المخططات أو آليات التعويض، ولم يُشرك السكان في اتخاذ القرار.

وأشار أحد حاضري الاجتماع من جوبر، إن المشروع المقترح يتجاهل كون المنطقة تعرضت لتدمير واسع خلال سنوات الحرب، ويتعامل معها كفضاء استثماري. ويضيف أن المقترحات الحالية تركز على تحسين المشهد العمراني ورفع القيمة السوقية للعقارات، من دون تقديم تصور واضح لمصير السكان أو ضمان عودتهم، مشيراً إلى أن الحديث عن أبراج ومشاريع على المحاور الرئيسية يُطرح باعتباره استثماراً لا كجزء من إعادة الحقوق.

كما يقول محمد عبيد، الذي يدير صفحة “شبكة حماية أراضي جوبر من المافيات العقارية” في فيسبوك التي يتابعها المئات، لسيريا ريبورت، إن المقترح تسرب من حاضري اجتماع المحافظة، وبينهم إعلاميين، من دون إعلان رسمي. ويضيف عبيد أن المقترح يتعارض مع روحية المرسوم الرئاسي رقم 59 الصادر في آذار 2026 القاضي بتشكيل لجنة وطنية لإعادة تأهيل البنى التحتية في المناطق المدمرة، كما يتعارض مع الإعلان الدستوري الذي نص في مادته 16 على أن الملكية الخاصة مصونة، ولا تُنزع إلا للمنفعة العامة مقابل تعويض عادل. وحذّر عبيد من أن تطبيق المقترح قد يؤدي إلى تهجير واسع باسم التنظيم العمراني وتحسين المشهد العام. ودعا عبيد إلى توسيع النقاش العام قبل اتخاذ أي قرار نهائي.

وفي محاولة لاحتواء الجدل، أكد مجلس أمناء حي جوبر، وهو جهة أهلية غير رسمية، أن الطرح الحالي لا يزال عرضاً شفهياً غير رسمي، ولم يُقدَّم بصيغة مكتوبة، وأن أي قرار نهائي سيخضع لدراسة لجنة مختصة ولموافقة الأهالي. وشدد المجلس على رفض أي مشروع لا يحقق الحد الأدنى من العدالة أو لا يضمن حق السكن، مؤكداً أن موقفه لا يعارض إعادة الإعمار بل يطالب بضمان حقوق السكان.

Backlash Over Reconstruction Plan for Jobar and Qaboun

On March 13, the Damascus Governorate held a meeting to present a reconstruction project for “the revival” of the areas east of the capital, including Jobar, Qaboun, and Bab Sharqi. Around 30 people attended the meeting, including members of neighbourhood committees, dignitaries from Qaboun and Jobar (but not from Bab Sharqi), as well as lawyers and engineers.

Mohammad Ismail Al-Bazri, the director of the Neighbourhood Committees Office in Damascus Governorate, said during the meeting that there is an official directive to bring in foreign companies to finance and implement the project, in exchange for receiving 50 per cent of the total project’s 1,100 hectares. The project has an estimated cost of USD 21 billion, and could create around 200,000 job opportunities, according to Mr Bazri. The USD 21 billion figure estimated by Mr Bazri seems excessive given that the World Bank estimated that the total cost of reconstruction in Syria stands at USD 216 billion.

Authorities are relying on foreign companies due to the limited capabilities of the Syrian private sector, as well as the government’s inability to finance the project, Mr Bazri said.

Other meeting attendees told The Syria Report that this deducted share would range between 50 percent of previously zoned areas and 70 percent of informal settlements built on land classified as agricultural. In return, owners of homes built in zoned areas would receive 50 per cent of the area of their former homes, in the residential buildings that the foreign companies would build for them. In the informal settlements, however, compensation would be set at 30 per cent of the area of land classified as “agricultural,” regardless of the unlicensed buildings constructed on it.

Calculating compensation based on a percentage of the original housing area is complex and difficult to estimate, given the scale of destruction in the two areas and the disappearance of many residential buildings. The proposal also did not take into account the rights of non-owners, including tenants of those properties.

Likewise, basing compensation on a percentage of agricultural land area in informal settlements ignores the reality of those settlements and the large number of buildings constructed on them, many of which are now destroyed, along with the rights of their owners.

Backlash among residents

Some actors from the Qaboun neighbourhood issued a statement on March 29 entitled “Towards Fair Reconstruction that Preserves Land and Dignity,” in which they explained their legal and planning position on the reconstruction proposal. The statement described some of the governorate’s proposals as potentially leading to “forced displacement with an administrative character,” stressing that private property rights after the fall of the Assad regime on 8 December 2024 are “sacred constitutional rights that cannot be diminished.” The signatories to the statement, including dignitaries, lawyers and professors, rejected the investment model being circulated, considering that it is based on imposing compensation rates not exceeding 30 percent of the land, which they described as “property dispossession,” and saw it as a violation of Article 16 of the Constitutional Declaration and an assault on the rights of owners.

Several representatives and residents from the two neighbourhoods, who considered that this model shifts the cost of the project onto the owners themselves, by deducting its cost from the area of their future buildings. Since many of these areas are informal settlements built on land classified as agricultural, where construction is prohibited, rights holders there would be the most harmed. They also pointed out that the proposal was not accompanied by the presentation of planning designs, nor by official clarifications regarding the implementing bodies, nor the mechanisms for compensation and valuation, which raised fears that the project might shift from reconstruction to a redistribution of ownership in favour of foreign companies.

Abu Mohammad, who is from Qaboun, says that the proposed compensation would result in him losing the majority of his property, which consists of a small building of several flats constructed on land classified as agricultural. This means that the limited compensation would be distributed among all the flat owners. He added that treating these lands as agricultural ignores their reality, as they have been inhabited and built up for many years and form an essential part of the urban fabric of the area. He said he feels that this classification significantly reduces the rights of owners and makes any plan that does not reassess it unfair. For Abu Mohammad, any amendment to the compensation rates, such as raising them from 30 to 50 percent, would not be sufficient unless it is based on a fair valuation reflecting the current value of the properties.

Some residents of Qaboun told The Syria Report that compensation should be based on the actual value of the property, or that it should provide an equivalent housing alternative in the same location, rather than moving rights holders to distant areas. The damage to their homes is also substantial, requiring a comprehensive approach. Some of them believe that the lack of transparency is the main problem, as details of the plans or compensation mechanisms have not been presented, and residents have not been involved in decision-making.

One attendee at the meeting from Jobar pointed out that the proposed project ignores the fact that the area was subjected to extensive destruction during the war years and treats it as an investment space. He added that the current proposals focus on improving the urban appearance and raising the market value of properties, without presenting a clear vision for the fate of residents or guaranteeing their return, noting that talk of towers and projects along the main axes is being framed as investment rather than as part of the restoration of rights.

Mohammad Obeid runs the Facebook page “Network for the Protection of Jobar Lands from Real Estate Mafias”, which has hundreds of followers. He told The Syria Report that the proposal was leaked by attendees at the governorate meeting, including journalists, without any official announcement.

Mr Obeid added that the proposal contradicts the spirit of Presidential Decree No. 59, issued in March 2026, which provided for the formation of a national committee to rehabilitate infrastructure in war-damaged areas, and also contradicts Artilce 16 of the the Constitutional Declaration — Article 16 of which stipulates that private property is protected and may not be expropriated except for the public benefit in return for fair compensation. He Obeid warned that implementing the proposal could lead to widespread displacement in the name of urban planning and improving the general appearance of the affected areas. He called for widening the public debate before any final decision is taken.

Law No.23 of 2015

The signatories of the statement called for the adoption of the Urban Planning and Cities Development Law No. 23 of 2015 as the legal framework for rezoning their areas, while stressing that owners should be granted the right to partition or to establish joint-stock companies, and the right to choose contractors, and rejecting the imposition of any investment entities upon them. Law No. 23 of 2015 provides for a planning mechanism based on the redistribution of ownership within a zoned area, whereby properties are merged into a single block and then redistributed in the form of shares equivalent to the original ownership value of each owner, after deducting a percentage of the area for roads, public facilities and services. The law sets a ceiling for the deductions that does not exceed 40 percent in city centres, and may be higher in cases related to urban expansion or unzoned areas, in accordance with zoning plans.

In return, the law guarantees rights holders the acquisition of zoned plots or planning shares reflecting the true value of their properties before rezoning with the possibility of participating in the development of the area through joint-stock companies or through partition with developers. It also provides for the formation of committees to estimate value and resolve disputes, and allows rights holders to object before the courts to the results of valuation or distribution. The law obliges the administrative body to secure the basic infrastructure, while charging the resulting plots with certain costs according to a specified system, rather than through unregulated deductions from ownership. The implementation instructions of the law show that part of the land is mandatorily allocated to social housing and public facilities, and that redistribution takes place on the basis of detailed plans determining roads, squares and services, on the basis that each owner receives a fair, buildable share within the new plots, while preserving their rights through Land Registry entries and the supervision of compulsory readjustment committees.

Law No. 23 of 2015 also deals explicitly with informal settlements located within zoned areas. It permits their inclusion in urban zoning projects and subjects them to the mechanism of compulsory readjustment, even where the buildings constructed on them are unlicensed. The law recognises the existence of these clusters as an urban reality and permits the recognition of the rights of occupants or owners within the planning process.

In this context, the law distinguishes between the legal ownership of the land and the reality of existing occupancy, as it allows existing buildings to be taken into account in valuation, even if their construction was illegal, through value assessment committees that determine the rights of each owner or occupant according to the situation. It also requires the inclusion of rights holders in distribution schedules and allows them to object before dispute resolution committees and the courts. This means that the existence of an unlicensed building does not automatically lead to the loss of rights, but rather to its inclusion in a zoning process that legally reproduces it within the new plots. The implementation instructions of the law also indicate that areas of collective violations are addressed within planning schemes through their redesign and the provision of infrastructure and services, with the possibility of allocating part of the land to social housing, reflecting an approach aimed at integrating these areas into the formal urban fabric.

The signatories to the statement also proposed an alternative urban vision based on the adoption of high-density residential towers, which would make it possible to grant owners floor rights of at least 55 percent and allow residents to be accommodated in modern units, instead of plans they believe reduce their rights. They stressed that implementing infrastructure is the responsibility of the state, while charging the costs to owners amounts to an “illegal tax.” They also called for the urgent repair of water and sewage networks, holding the official bodies responsible for the neglect that they said had negative health effects on local residents. The signatories warned against any negotiations conducted outside the framework of their representation, adding that any agreement not passing through an authorised legal committee is non-binding. They called on owners not to sell their properties under pressure, and to hold firmly to their rights, in order to guarantee a return to their original areas under conditions that preserve ownership and dignity.

In an attempt to contain the controversy, the Board of Trustees of Jobar neighbourhood, an unofficial community body, confirmed that the current proposal remains a verbal and unofficial presentation and has not been submitted in written form, and that any final decision will be subject to study by a specialised committee and to the approval of residents. The board stressed its rejection of any project that does not achieve the minimum level of justice or does not guarantee the right to housing, affirming that its position does not oppose reconstruction but rather demands guarantees for the rights of residents.

اقترح المجلس المحلي في مدينة عين ترما بريف دمشق، تحديثاً جديداً للمخطط التنظيمي يقوم على توسيع حدود المدينة ورفع الكثافة العمرانية، عبر ضم مناطق غير منظمة والسماح ببناء أبراج سكنية، مع زيادة عدد الطوابق المسموح بها، وإتاحة بناء أبراج سكنية في كامل المدينة وليس فقط في المناطق المتضررة.

تقع عين ترما على بعد نحو كيلومترين من منطقة الزبلطاني في دمشق، ويفصلها عن حي جوبر طريق المتحلق الجنوبي، ما يجعلها من أقرب مدن الغوطة الشرقية إلى العاصمة. وتنقسم المدينة إلى مناطق منظمة تخضع لمخطط تنظيمي كان آخر تحديث له في 2009 بموجب القرار 150، والذي سمح برفع عدد الطوابق إلى 5 طوابق، خاصة للأبنية المطلة على الطرق العامة.

رئيس بلدية عين ترما وائل سلام، قال لسيريا ريبورت، إن التحديث المقترح يتضمن ضم منطقة حرم المتحلق الجنوبي باتجاه جوبر، وهي منطقة غير منظمة يمكن استثمارها عبر بناء أبراج سكنية أو تخصيصها كمرافق عامة. كما يشمل المقترح ضم منطقة مسجد أقصاب الواقعة على طرف البلدة، والتي لا تخضع حالياً لأي جهة إدارية، بهدف إخضاعها لسلطة البلدية ومنح رخص البناء فيها. وأضاف سلام أن المقترح يشمل أيضاً ضم منطقة المحاريق، التي انفصلت عن جوبر بعد شق المتحلق الجنوبي، وتحولت إلى منطقة عشوائية نتيجة غياب المرجعية الإدارية، حيث لم تعد بلدية جوبر تتدخل فيها، في حين لا تمتلك بلدية عين ترما سلطة عليها. وأوضح سلام أن من بين التعديلات المقترحة تعديل ضابطة البناء والسماح بإقامة أبراج سكنية دون تحديد عدد الطوابق، معتبراً أن ذلك يشكل حافزاً للاستثمار في المدينة، في ظل توجه البلدية لتقديم تسهيلات للمستثمرين.

العشوائيات ومخالفات البناء بين القمع والتوسع

تضم عين ترما مناطق عشوائية واسعة، أبرزها بستان النسيم المعروف بالطبالة، إضافة إلى أراض زراعية شهدت توسعاً في مخالفات البناء، خاصة في وادي عين ترما. وبحسب أرقام حصلت عليها سيريا ريبورت من البلدية، قامت الأخيرة خلال الأسابيع الماضية بهدم نحو 15 بناء مخالف في تلك المناطق، مع تشديد إجراءات ضبط المخالفات، في محاولة للحد من توسع العشوائيات، خاصة مع الإعلان عن مقترح المخطط التنظيمي الجديد. يعكس هذا التشدد محاولة ضبط التوسع العمراني غير المنظم في مرحلة حساسة، حيث يتزامن طرح التوسع التنظيمي مع استمرار البناء المخالف في الأطراف، ما يضع البلدية أمام معادلة مزدوجة بين التنظيم والقمع.

الاستثمار العقاري ودور البلدية كوسيط

أشار وائل سلام، إلى أن البلدية استقبلت بعض المستثمرين الذين أبدوا استعدادهم للدخول في مشاريع بناء حديثة، موضحاً أن دور البلدية يقتصر على تسهيل الإجراءات وربط المستثمرين بالمالكين للوصول إلى اتفاقات بينهم، دون التدخل في تفاصيل تلك الاتفاقات. وذكر مثالاً عن مستثمر يعمل على تنفيذ نحو 15 بناء في المدينة بعد التوصل إلى اتفاقات مع المالكين، ما يعكس بداية تشكل نمط من التطوير العقاري القائم على الشراكات الخاصة.

وبحسب سلام، يتراوح سعر متر البناء بين 200 و400 دولار حسب الموقع، في حين أكد المستثمر بشار شعبان، وهو من أبناء جوبر ويستثمر في عين ترما، أن الحركة العمرانية موجودة لكنها محدودة بسبب ضعف الخدمات، رغم ارتفاع الأسعار. وأضاف أن بدلات الإيجار تتراوح بين 150 و250 دولار شهرياً بحسب حالة العقار.

الدمار الواسع وعودة السكان بشروط قاسية

رصد مراسل سيريا ريبورت، دماراً كبيراً في المدينة، خاصة في الواجهة المطلة على المتحلق الجنوبي باتجاه جوبر ومنطقة الشملند، نتيجة القصف المكثف بين 2013 و2018، بعد خروج المدينة عن سيطرة نظام الأسد في 2013. كما تعرضت مناطق التنظيم لدمار واسع، حيث سويت أجزاء كبيرة من الأبنية بالأرض، وبقيت مساحات واسعة من المدينة مغطاة بالأنقاض.

وتبقى عودة السكان إلى المناطق المدمرة بطيئة، خاصة في الشملند، حيث تعيش بعض العائلات في منازل متضررة بشدة، دون نوافذ أو أبواب، وتستخدم أغطية لإغلاق الفتحات، لعدم قدرتها على تحمل تكاليف الترميم. كما تقيم عائلات أخرى في مناطق تفتقر إلى شبكات الصرف الصحي والخدمات الأساسية، ما يفرض ظروفاً معيشية صعبة في ظل غياب بدائل سكنية.

وبحسب تقديرات أصحاب مكاتب عقارية من أبناء المنطقة، هناك نحو 100 بناء مدمر يحتاج إلى إعادة بناء كاملة، مقابل 600 بناء يحتاج إلى ترميم، أي ما يعادل نحو 5000 شقة. ويبلغ عدد سكان عين ترما حالياً نحو 130 ألف نسمة، بينهم حوالي 40 بالمئة من أهالي جوبر الذين نزحوا إليها بسبب الدمار الكبير في حيهم، وقرب المسافة بين المنطقتين.

Ayn Tarma Master Plan Undergoes Expansion

The local council in the city of Ayn Tarma in Rural Damascus has proposed a new revision to the master plan based on expanding the city’s boundaries and increasing urban density. This will be done by incorporating unzoned areas and allowing the construction of residential towers, with an increase in the number of permitted storeys, and permitting the construction of residential towers throughout the entire city and not only in the damaged areas.

Ayn Tarma is located around two kilometres from the Zablatani area in Damascus and is separated from the Jobar neighbourhood by the Southern Ring Road, making it one of the closest towns in East Ghouta to the capital. The city is divided into zoned areas subject to a master plan, the most recent revision of which was in 2009 under Decision No. 150, which raised the allowed number of storeys to five, especially for buildings overlooking public roads.

Wael Salam, the mayor of Ayn Tarma, told The Syria Report that the proposed revision includes incorporating the area of the Southern Ring Road reserve towards Jobar, which is an unzoned area that can be invested in through the construction of residential towers or allocated as public facilities. The proposal also includes incorporating the Aqsab Mosque area located on the edge of the town, which is currently not subject to any administrative authority, with the aim of bringing it under the municipality’s authority and granting building permits there.

The proposal also includes incorporating the Mahariq area, which was separated from Jobar after the Southern Ring Road was cut through, and turned into an informal settlement as a result of the absence of an administrative authority, since Jobar municipality no longer intervenes there, Mr Salam added. He explained that among the proposed amendments is to update the building code and permit the construction of residential towers without specifying the number of storeys, as this would incentivise investment in the city.

Informal settlements and unlicensed construction

Ayn Tarma contains large informal settlements, most notably Bustan Al-Naseem, also known as Al-Tabbaleh, in addition to agricultural land that has seen an expansion in unlicensed construction, especially in the Wadi Ayn Tarma area.

The municipality demolished around 15 unlicensed buildings in those areas during recent weeks, while tightening measures to control violations, in an attempt to curb the expansion of informal settlements, especially with the announcement of the proposed new master plan. Real estate investment 

The municipality has received between three and four investors who expressed readiness to enter into modern construction projects, explained Mr Salam, adding that that the municipality’s role is limited to facilitating procedures and linking investors with owners in order to reach agreements between them, without intervening in the details of those agreements, as its role is limited to facilitating procedures. He cited the example of an investor working on implementing around 15 buildings in the city after reaching agreements with owners, which reflects the emergence of a pattern of real estate development based on private partnerships.

According to Salam, the price per metre of construction ranges between USD 200 and 400 depending on the location.

Investor Bashar Shaaban, who is from Jobar and invests in Ayn Tarma, confirmed that building activity exists but remains limited because of weak services, despite rising prices. He added that rents range between USD 150 and 250 per month depending on the condition of the property.

Widespread destruction 

Destruction is widespread in Ayn Tarma, especially in the area overlooking the Southern Ring Road towards Jobar, as well as the Shamland neighbourhood, as a result of intensive shelling between 2013 and 2018, after the city fell out of the control of the Assad regime in 2013. The formally planned areas were also subjected to widespread destruction, with large parts of buildings, including entire upper floors, levelled to the ground, and wide areas of the city remaining covered in rubble.

Residents are still slow to return to Ayn Tarma, especially Shamland, where some families live in severely damaged homes without windows or doors, using blankets instead because they cannot afford repairs. Other families also live in areas lacking sewage networks and basic services, adding to daily hardships without housing alternatives.

According to estimates by real estate agents from the area, there are around 100 destroyed buildings that need complete reconstruction, compared with 600 buildings in need of repair, equivalent to around 5,000 flats. The current population of Ain Tarma is around 130,000, including approximately 40 percent from Jobar who were displaced there because of the extensive destruction in their neighbourhood and the short distance between the two areas.

معارك قانونية لاستعادة الأملاك المغتصبة جنوبي دمشق

واجه عائدون إلى مخيم اليرموك وحي التضامن جنوبي دمشق، مشاكل معقدة تتعلق بملكياتهم العقارية، بعد اكتشافهم عمليات بيع واستيلاء عليها تمت بموجب عقود مزورة أو تحت الضغط الأمني خلال سنوات غيابهم عنها. وبحسب الوقائع والشهادات الميدانية التي حصلت عليها سيريا ريبورت، فإن شبكات تضم سماسرة وأصحاب مكاتب عقارية وأحياناً محامين، كانت قد استغلت أوضاع بعض المُهجّرين، وفقدانهم وثائقهم الشخصية والعقارية، واحتالت عليهم لسلبهم ممتلكاتهم.

التزوير عبر الوثائق المفقودة

في نيسان 2025، عاد خليل إلى منزله بعد سنوات من التهجير في لبنان، ليجد عائلة غريبة تقطن منزله الواقع باتجاه الفرن الآلي على طرف مخيم اليرموك، الذي كان يضم غالبية من النازحين الفلسطينيين مع خليط من مواطنين سوريين، ممن تعرضوا لموجتي تهجير؛ الأولى جزئية في العام 2012، والثانية شاملة في العام 2018 بعد سيطرة قوات النظام على المنطقة.

يروي خليل لسيريا ريبورت، أنه وزوجته وابنه، نزحوا من المخيم في كانون الأول 2012، هرباً من قصف الدبابات التابعة لقوات نظام الأسد. النزوح كان مفاجئاً، إذ ترك الزوجان الشقة، ومرّا على معهد الخيام لاصطحاب ابنهما الطالب في الصف الثالث الثانوي حينها. في ذلك الجو المشحون بالرعب، لم يأخذ الزوجان معهما سوى مبلغ مالي سبق ورصدوه لمثل تلك اللحظة. لكن خليل نسي هويته الشخصية في المنزل.

يقول خليل أنه بعد عودته إلى منزله في المخيم، واجه العائلة التي تقطنه من غير علمه. ويضيف: “أكد لي رب الأسرة أنه اشترى الشقة بعقد بيع قطعي عن طريق أحد سماسرة العقارات في المنطقة، وأبرز لي نسخة العقد. وهنا كانت الصدمة، حيث تبين أن العقد تم بين الشاغل الحالي للعقار والسمسار بوصفه وكيلاً عني”. ويرجح خليل أن يكون السمسار قد حصل على هويته الشخصية التي تركها خلفه، فنظم وكالة خاصة، وتصرف بالمنزل. يقول خليل إنه علم أن السمسار هرب من المخيم بعد سقوط نظام الأسد بفترة قصيرة.

خليل وكّل محام لاستعادة عقاره، والذي فضّل اعتبار شاغل العقار الحالي هو طرف ثالث “حسن النية” وقع ضحية احتيال السمسار، لا كغاصب للعقار. وبناء على ذلك، رفع المحامي دعوى لإثبات تزوير الوكالة أولاً، ثم إبطال سلسلة البيوع التي ترتبت عليها ثانياً.

البيع القسري أو تلفيق الاتهامات

في حي التضامن المجاور، والذي يضم خليطاً من الطوائف، اتخذت الانتهاكات شكلاً آخر، ارتبط بالابتزازات والتهديدات. يروي سامر، النازح منذ عام 2012 إلى منطقة مساكن برزة، لسيريا ريبورت، رحلة العذاب التي خاضها للحفاظ على بيته، والتي انتهت بتوقيع قسري على عقد بيعه. المنزل يقع في منطقة مسبق الصنع بالتضامن التي تضررت جزئياً بسبب القنص، والقصف بالقذائف. وسامر ما زال يحتفظ بأوراق المنزل الثبوتية، ومنها سند الملكية.

يقول سامر: “منذ لحظة نزوحي، ظل قلبي معلقاً بجدران منزلي الذي بنيته بشق النفس، وذقت مرارة العمل 18 ساعة في اليوم لدفع إيجار شهري في مساكن برزة”. ومع انتهاء القتال في التضامن وسيطرة قوات النظام على الحي في العام 2018، تجدد الأمل لدى سامر بالعودة، فهو لم يشارك بأي أعمال قتالية مع أي جهة كانت، بحسب ما قاله.

في 8 تموز 2019، تلقى سامر اتصالاً هاتفياً “غيّر مسار حياتي تماماً، بعدما كنت أعيش على أمل العودة القريبة”. ويتابع: “كان المتصل وسيطاً عقارياً يُعرف بصلاته الوثيقة بالأجهزة الأمنية، وخيّرني بين الموافقة على بيع منزلي بمبلغ 7 ملايين ليرة سورية فقط، وبين مواجهة العواقب في حال رفضي”. الأسعار الرائجة للمنازل التي تشبه حالة منزل سامر، كانت تتراوح في ذلك الوقت بين 13 إلى 15 مليون ليرة، بحسب ما قاله. السمسار هدد سامر من العودة إلى الحي، وأخبره بأنه بات مطلوباً للأجهزة الأمنية. وعندما لم ينفع ذلك، هدد السمسار سامر، بأنه “سيلقى حتفه إن عاد إلى التضامن، ولن يعلم بأمره أحد”. يقول سامر إن التهديدات وصلت إلى اتهامه من قبل السمسار بتمويل الإرهاب، وإن لم يتنازل عن منزله سيواجه ملاحقة أمنية بسبب “تعامله مع جهات خارجية”. وبعد أسابيع من التردد، رضخ سامر للسمسار وباع منزله بذلك السعر، كي “لا يواجه مصيراً مجهولاً” في حال تقديمه شكوى للشرطة أو رفعه لدعوى في المحكمة.

وبعد سقوط نظام الأسد، سامر استشار محامياً أخبره بأنه طالما جرى البيع تحت الإكراه، يمكن إبطاله في حال إثبات ذلك. ويمكن إثبات وقوع الإكراه، عبر مقارنة سعر المنزل المُباع، بالقيم الرائجة آنذاك. هذا النمط من البيوع موثق رسمياً في السجلات العقارية، ولكنه يفتقد لعنصر الرضا.

تشكيل لجنة وطنية لإعادة تأهيل البنى التحتية تمهيداً لإعادة النازحين وإغلاق المخيمات

أصدر رئيس المرحلة الانتقالية أحمد الشرع المرسوم رقم 59 في 8 آذار الجاري، القاضي بتشكيل لجنة وطنية لإعادة تأهيل البنى التحتية في المناطق المدمرة، بهدف تهيئة الظروف لعودة النازحين وإغلاق المخيمات، وذلك في ظل تزايد الانتقادات الموجهة للحكومة المؤقتة بسبب تدهور أوضاع المخيمات وتراجع دعم المنظمات الدولية.

نص المرسوم 59 على تشكيل لجنة برئاسة وزير الطوارئ وإدارة الكوارث، وعضوية وزراء الأشغال العامة والإسكان، والشؤون الاجتماعية والعمل، والإدارة المحلية والبيئة، إضافة إلى محافظي حلب وحماة وإدلب، ومدير التعاون الدولي في وزارة الخارجية والمغتربين. وتتولى اللجنة العمل على تهيئة البنى التحتية في المناطق المدمرة تمهيداً لعودة الأهالي، إضافة إلى اتخاذ كافة الإجراءات التي من شأنها رفع المستوى الخدمي في مناطق النزوح إلى حين عودة السكان إلى مناطقهم الأصلية. وتجتمع اللجنة كل 15 يوماً أو عند الحاجة بدعوة من رئيسها، وترفع تقريراً شهرياً إلى رئاسة الجمهورية حول نتائج أعمالها.

وقال وزير الطوارئ وإدارة الكوارث رائد الصالح لسيريا ريبورت، إن الهدف من تشكيل اللجنة هو الوصول إلى “سوريا من دون مخيمات”. وأضاف أنه سيتم تشكيل لجنتين فرعيتين بإشراف اللجنة الأساسية، الأولى مالية تتولى الإشراف على الموازنات، والثانية تنفيذية تضم ممثلين عن الوزارات والمحافظات غير الممثلة في اللجنة الأساسية، وتكون مسؤولة عن العمل الميداني والتنسيق بين الجهات المعنية. كما أشار إلى أن مهمة اللجنة تشمل التنسيق مع المنظمات الدولية، ووضع رؤية عامة وجدول زمني لإنهاء العمل.

يتدهور وضع المخيمات في الشمال السوري مع استمرار تأخر إيجاد حلول واضحة لإعادة النازحين، ومع اعتماد معظم العائدين على ترميم منازلهم بجهودهم الذاتية. وبحسب معلومات حصلت عليها سيريا ريبورت، من مديرية الشؤون الاجتماعية والعمل في إدلب، بلغ عدد المخيمات في الشمال السوري نحو 800 مخيم، يقطنها أكثر من 120 ألف شخص. وتتركز هذه المخيمات في الدانا، سرمدا، أطمة، حارم، سلقين، كفرتخاريم، بداما، خربة الجوز ومناطق أخرى متفرقة. وتعد مخيمات الدانا من الأكثر خطورة، إذ تتعرض بشكل متكرر للسيول والفيضانات بسبب غياب مقومات السلامة، وهو ما ظهر خلال الشهر الحالي حين غرقت عدة مخيمات نتيجة هذه الظروف.

الخطة الحالية تقوم على التنسيق مع المنظمات الدولية والمحلية لتقديم مساعدات إسعافية فقط داخل المخيمات، من دون التوسع في تقديم خدمات مستدامة، بهدف عدم تكريس بقاء هذه المخيمات. في المقابل، يجري العمل على تقديم خدمات مستدامة في المناطق المدمرة، تشمل تأهيل شبكات الكهرباء والمياه والصرف الصحي، بما يشجع السكان على العودة. كما تتضمن الخطة متابعة العائلات العائدة إلى مناطقها، وتقديم الدعم لها بالتعاون مع الجهات الفاعلة. وتشمل آلية الدعم تقديم مساعدات مالية للعائدين من خلال قروض ميسرة، أو عبر التبرعات، حيث تواصل عدد من الأفراد مع مديرية شؤون إدلب لتقديم مبالغ مالية لدعم ترميم المنازل، إضافة إلى الدعم الذي تقدمه المنظمات الدولية والمحلية.

ومن المتوقع عقد اجتماع بين وزارة الطوارئ وعدد من المنظمات خلال الأسبوع المقبل لوضع خطة واضحة للدعم المالي، تتضمن تقييم الأضرار في المنازل وتحديد أولويات الدعم وفق نسبة الضرر، بدءاً من المنازل الأكثر تضرراً ثم الأقل، بهدف الوصول إلى أكبر عدد ممكن من النازحين. كما تشمل الخطة تأهيل البنى التحتية في المناطق المتضررة من طرق وشبكات صرف صحي وكهرباء.

وبعد 8 كانون الأول 2024، عاد عدد من الأسر من المخيمات إلى مناطقهم، إلا أن كثيراً منهم واجه صعوبات حالت دون استقرارهم، بسبب تضرر المنازل وسوء البنى التحتية، ما أدى إلى تراجع وتيرة العودة بعد فترة من الارتفاع، في ظل استمرار تأخر إعادة الإعمار وتأهيل المناطق المتضررة. يرتبط إغلاق المخيمات بمدى التقدم في تأهيل البنى التحتية وتوفير الخدمات في مناطق العودة، إضافة إلى قدرة الجهات المعنية على تنفيذ خطط الدعم وإعادة الإعمار وفق الأولويات المحددة.

National Committee Formed to Prepare Infrastructure for Returnees

Syria’s Transitional President, Ahmad Al-Sharaa, issued Decree No. 59 on March 8, forming a national committee to rehabilitate infrastructure in heavily damaged areas. The aim is to allow displaced people to return, as well as to close various displacement camps, amid growing criticism directed at the  government due to the deteriorating conditions in the camps and the decline in support from international organisations.

Decree No. 59 stipulated the formation of a committee chaired by the Minister of Emergency and Disaster Management and it includes: the Ministers of Public Works and Housing, Social Affairs and Labour, Local Administration and Environment, the Director of International Cooperation at the Ministry of Foreign Affairs and Expatriates,in addition to the governors of Aleppo, Hama and Idlib (where most camps are.)

The committee is tasked with preparing infrastructure in heavily damaged areas in preparation for the return of residents, in addition to improving public services in the areas of displacement until residents return to their original areas. The committee meets every 15 days or when necessary at the invitation of its chair, and submits a monthly report to the presidency on the results of its work.

The Minister of Emergency and Disaster Management, Raed Al-Saleh, told The Syria Report that the aim of forming the committee is to reach “a Syria without camps.” He added that two subcommittees will be formed under the supervision of the main committee: the first, financial, will oversee budgets, while the second, executive, will include representatives of ministries and governorates not represented in the main committee, and will be responsible for fieldwork and coordination among the relevant bodies. The committee’s task includes coordination with international organisations, and the development of a general vision and timetable for completing the work, the minister said.The situation in the displacement camps in northern Syria continues to deteriorate amid a lack of clear solutions for return, while most returnees are paying to repair their war-damaged homes out of pocket. According to the Directorate of Social Affairs and Labour in Idlib, there are around 800 displacement camps in northern Syria, inhabited by more than 120,000 people. These camps are concentrated in Dana, Sarmada, Atmeh, Harem, Salqin, Kafr Takharim, Badama, Khirbet Al-Joz, and other scattered areas. The camps in Dana are considered among the most dangerous, as they are repeatedly exposed to floods due to the lack of basic safety measures.

The current plan is based on coordination with international and local organisations to provide emergency assistance only inside the camps, without expanding sustainable services, so as not to prolong the existence of these camps. By contrast, work is under way to provide sustainable services in the war-damaged areas, including the rehabilitation of electricity, water and sewage networks, in a way that encourages residents to return. The plan also includes following up with families returning to their areas and providing them with support in cooperation with relevant actors. The support mechanism includes providing financial assistance to returnees through soft loans, or through donations, as a number of individuals have contacted the Idlib Social Affairs Directorate to give money to support house repairs, in addition to the support provided by international and local organisations.

A meeting is expected to be held between the Ministry of Emergency and a number of organisations during the coming week to develop a clear plan for financial support, including the assessment of damage to homes and the determination of support priorities according to the extent of the damage, starting with the most damaged homes and then the less damaged ones, with the aim of reaching the largest possible number of displaced people. The plan also includes rehabilitating infrastructure in the affected areas, including roads, sewage networks and electricity.

After the fall of the regime in December 2024, a number of families returned from the camps to their areas, but many of them faced difficulties that prevented them from settling permanently, due to housing damage and poor infrastructure. These issues led to a decline in the pace of return after a period of increase, amid the continued delay in reconstruction and the rehabilitation of the affected areas. 

The closure of the camps is linked to progress in rehabilitating infrastructure and providing services in areas of return, as well as to the ability of the relevant bodies to implement support and reconstruction plans according to defined priorities.

Returnees Face Legal Battles to Take Back Usurped Properties in Damascus

Returnees to the Yarmouk Palestinian refugee camp and the nearby Tadhamon neighbourhood south of Damascus face complex problems relating to their property ownership after discovering that their properties had been sold or seized under forged contracts or through security pressure during the years of their absence. 

Networks including brokers, owners of real estate agencies, and sometimes lawyers exploited the circumstances of some displaced people, and the loss of their personal and property documents, and defrauded them in order to strip them of their possessions.

Forgery through missing documents

The Yarmouk camp, now mostly destroyed, had been home mostly to Palestinian refugees, along with a mix of Syrian citizens, all of whom were subjected to two waves of displacement: the first partial one in 2012, and the second comprehensive one in 2018 after Assad regime forces took control of the area.

In April 2025, Khalil returned to his home after years of displacement in Lebanon, only to find another family living in his house on the edge of Yarmouk Camp. 

Khalil, his wife, and son were displaced from the camp in December 2012, fleeing shelling by tanks belonging to Assad regime forces. Their departure was sudden, as the couple left the flat to pick up their son, who was then a student in his final year of secondary school. In that atmosphere charged with terror, the couple took only a small amount of money but Khalil forgot his identity card at home.

Khalil says that after returning to his home in the camp, he confronted the family living there without his knowledge. “The head of the family confirmed to me that he had bought the flat under a final sale contract through one of the property brokers in the area, and he showed me a copy of the contract. That was the shock, as it became clear that the contract had been concluded between the current occupier of the property and the broker acting as my representative,” he said.

Khalil figured that the broker obtained the personal identity card he had left behind, prepared a special power of attorney, and disposed of the house. Khalil said that he learned that the broker fled the camp a short time after the fall of the Assad regime.

To recover his property, Khalil appointed a lawyer, who preferred to consider the current occupier of the property a third party acting “in good faith” who had fallen victim to the broker’s fraud, rather than a usurper of the property. On that basis, the lawyer filed a lawsuit, first to prove the forgery of the power of attorney, and secondly to annul the chain of sales resulting from it.

Forced sale and fabricated accusations

In the nearby Tadhamon neighbourhood, which includes a mix of sects, the violations took the form of outright extortion and threats. 

Samer, who has been displaced since 2012 to the Barzeh Housing area, told The Syria Report about the ordeal he went through to keep his house, which ended with him being forced to sign its sale contract. The house is located in the prefabricated housing area of Tadhamon, which was partially damaged by sniping and shelling. Samer still retains the house’s official papers, including the title deed.

“From the moment I was displaced, my heart remained tied to the walls of my house, which I built through sheer struggle,” Samer said. “I tasted the bitterness of working 18 hours a day to pay monthly rents in Barzeh Housing,” he added.

With the end of the fighting in Tadhamon and Assad regime forces taking control of the neighbourhood in 2018, Samer’s hope of return was renewed, as he claims he had not taken part in any combat activities with any side.

On July 8, 2019, Samer received a phone call that “changed the course of my life completely, as I had been living in hope of an imminent return”. The caller was a property middleman known for his close ties to the security services. “He gave me a choice between agreeing to sell my house for only SYP 7 million, and facing the consequences if I refused,” he said. The prevailing prices for houses in a condition similar to Samer’s ranged at that time between SYP 13 million and SYP 15 million, according to him. 

The broker warned Samer against returning to the neighbourhood and told him that he had become wanted by the security services. When that did not work, the broker threatened Samer that he “would meet his death if he returned to Tadhamon, and no one would know anything about him.” Samer said that the threats went as far as the broker accusing him of financing terrorism, and that if he did not give up his house, he would face security prosecution because of his “dealings with external parties.” After weeks of hesitation, Samer yielded to the broker and sold his house at that price so that he would “not face an unknown fate” if he filed a complaint with the police or brought a case before the court.

After the fall of the Assad regime, Samer consulted a lawyer who told him that, since the sale had taken place under duress, it could be annulled if that were proven. The occurrence of duress can be proven by comparing the price of the house sold with the prevailing values at that time. This pattern of sales is officially documented in the property records, but lacks the element of consent.

التحضير لكود وطني سوري جديد للبناء

بدأت الحكومة الانتقالية العمل على إعداد “كود وطني سوري” جديد لمعايير الأمن والسلامة في عمليات بناء المساكن والمنشآت الصناعية والسياحية. يهدف المشروع الجديد إلى وضع إطار أشمل لمعايير الأمن والسلامة في البناء، يشمل اشتراطات التصميم المقاوم للزلازل والحرائق والكوارث الطبيعية، وضمان السلامة الإنشائية للمباني.

ومن المتوقع أن يحل الكود الجديد محل الكود المعمول به حالياً “الكود العربي السوري لتصميم وتنفيذ المنشآت بالخرسانة المسلحة“، وهو نظام عمراني إنشائي يحدد أسس تصميم وتنفيذ الأبنية بحيث تحقق الحد المقبول من مقاييس السلامة في البناء. وقد اعتمدت نقابة المهندسين السوريين النسخة الأولى من هذا الكود في 1992، قبل أن تطور نسخة ثانية منه في 1995 تضمنت اشتراطات إنشاء الأبنية المقاومة للزلازل. وكان الالتزام بتطبيق الكود العربي السوري لتصميم وتنفيذ المنشآت بالخرسانة المسلحة شرطاً للحصول على رخصة بناء، إذ يلتزم المهندسون بإدراجه في الدراسات الإنشائية المقدمة مع طلب الترخيص، فيما تشرف نقابة المهندسين السوريين والبلديات على التقيد بتطبيقه خلال مراحل الترخيص والتنفيذ.

الأمانة العامة لرئاسة الجمهورية، شكلت في شباط الماضي، لجنة عليا كلفتها إعداد الكود الوطني السوري الجديد، وأيضاً مشروع قانون سيُعرض على مجلس الشعب، بهدف منح الكود صفة تشريعية ملزمة، وإلزام البنائين بتطبيق معاييره في عمليات البناء وفرض عقوبات على المخالفين. وذلك ينقل الكود من كونه مرجعاً فنياً يُفرض تطبيقه عبر إجراءات الترخيص والإشراف المهني، إلى إطار قانوني ملزم يصدر بقانون ويتيح ملاحقة المخالفات قضائياً.

وبحسب مراسل سيريا ريبورت، فإن مشروع القانون الجديد سيشترط موافقة نقابة المهندسين، وأيضاً موافقة وزارة الطوارئ وإدارة الكوارث، على مشاريع البناء المستقبلية، لمراقبة تطبيق معايير السلامة بموجب الكود. كما يفرض القانون عقوبات على من لا يلتزم بمعايير الكود.

اللجنة العليا المكلفة بإعداد الكود الوطني السوري، عقدت اجتماعها التحضيري الأول في 11 آذار 2026، الذي حضره مراسل سيريا ريبورت. وتتألف اللجنة من 24 عضواً ويرأسها وزير الطوارئ وإدارة الكوارث، وتضم ممثلين عن وزارات الطوارئ وإدارة الكوارث، والأشغال العامة والإسكان، والإدارة المحلية والبيئة، والاقتصاد والصناعة، إضافة إلى ممثلين عن نقابة المهندسين السوريين، وجامعتي حمص واللاذقية، وهيئة المواصفات والمقاييس العربية السورية التي تتبع لوزارة الاقتصاد والصناعة والمسؤولة عن إعداد واعتماد المواصفات القياسية الوطنية للمنتجات والمواد بما في ذلك مواد البناء.

وناقشت اللجنة خلال اجتماعها التحضيري الأول آلية العمل لإعداد الكود الجديد، بما يشمل مراجعة الأكواد العربية والعالمية المعتمدة في مجال البناء، بهدف الاستفادة من التجارب المقارنة في وضع معايير السلامة والإنشاء. كما يجري العمل على تشكيل لجان فنية متخصصة في مجالات الجملة الإنشائية للبناء والوقاية من الحرائق، تتولى إعداد المسودة الأولية للكود الوطني السوري، بما يتضمن الشروط والمعايير الفنية الخاصة بسلامة الأبنية والمنشآت.

يحسب المراسل فإنه مسودة القانون، بدورها، ستخضع لمراجعة قانونية للتأكد من توافقها مع القوانين والتشريعات النافذة، قبل عرضها على الجهات العامة المعنية بالبناء والتخطيط العمراني لإبداء الملاحظات والمقترحات عليها. وفي المرحلة الأخيرة، يُفترض إصدار الكود، واخضاعه لاحقاً لمراجعات دورية بهدف تحديثه بما يتوافق مع التطورات التقنية في قطاع البناء. وأيضاً، اصدار قانون يلزم الراغبين بالبناء بتطبيق معايير السلامية الانشائية التي ينص عليها الكود.

وزير الطوارئ وإدارة الكوارث رائد الصالح، قال خلال اجتماع اللجنة العليا، بوجود قصور في تحديث الكود السوري القديم، معتبراً أن البلاد تفتقر إلى كود واضح وشامل يتعلق بالأمن والسلامة والوقاية من الحرائق والكوارث الطبيعية، وهو ما ظهرت نتائجه بوضوح بعد زلزال شباط 2023. وأشار الصالح إلى أن الحاجة إلى كود وطني جديد تزداد مع التوسع العمراني المتوقع في البلاد، بما في ذلك مشاريع الأبراج السكنية والمشاريع العمرانية الكبيرة، الأمر الذي يتطلب وجود معايير إنشائية حديثة تواكب التطورات العالمية في مجال البناء. كما شدد على أهمية دور نقابة المهندسين في مراقبة تطبيق معايير الكود على أرض الواقع.

وأشار الصالح إلى أن المشكلة لا تقتصر على تحديث الكود فحسب، بل تشمل أيضاً ضعف الالتزام بتطبيق معايير الأمن والسلامة في عدد كبير من الأبنية السكنية والمنشآت الصناعية والسياحية. وضرب الصالح مثالاً بمستودع في ريف إدلب تعرض لحريق في مطلع شباط الماضي لم يتمكن الدفاع المدني من إخماده بسبب عدم وجود مخرج طوارئ، ما أدى إلى خسائر كبيرة لصاحبه. كما أشار إلى حادثة انهيار مبنى من 4 طوابق في حي الأشرفية في مدينة حلب في 7 آذار، نتيجة ضعف الأساسات والأعمدة، الأمر الذي صعّب على فرق الدفاع المدني رفع الأنقاض وإنقاذ الضحايا، وأسفر عن سقوط 10 قتلى.

Transitional Government Prepares New National Building Safety Code

The transitional government is preparing a new “Syrian National Code” for safety standards in the construction of housing, industrial facilities, and tourist establishments. The new project aims to establish a more comprehensive framework for safety standards in construction, including requirements for earthquake-resistant design, fire safety, and resilience to natural disasters, as well as ensuring the structural safety of buildings.

The new code is expected to replace the current ‘Syrian Arab Code for the Design and Implementation of Reinforced Concrete Structures,’ a structural engineering code that sets the foundations for designing and constructing buildings to achieve minimum safety standards. The Syrian Engineers Syndicate adopted the first version of this code in 1992, before developing a second version in 1995 that included requirements for constructing earthquake-resistant buildings. Compliance with this code is a condition for obtaining a construction permit, as engineers are required to include it in the structural studies submitted with licensing applications, while the Syrian Engineers Syndicate and municipalities supervise adherence to its application during the licensing and implementation stages.

Last February, the General Secretariat of the Presidency formed a higher committee tasked with preparing the new Syrian National Code, as well as a draft law that will be presented to the People’s Assembly, with the aim of granting the code legal binding status and obliging builders to apply its standards in construction operations while imposing penalties on violators. This would move the code from being a technical reference enforced through licensing procedures and professional supervision to a binding legal framework that allows violations to be pursued judicially.

The new draft law will require approval from the Syrian Engineers Syndicate and the Ministry of Emergency and Disaster Management for future construction projects in order to monitor the application of safety standards under the code. The law will also impose penalties on those who fail to comply with the code’s standards.

The higher committee tasked with preparing the Syrian National Code held its first preparatory meeting on March 11, which was attended by one of our correspondents. The committee consists of 24 members and is chaired by the Minister of Emergency and Disaster Management. It includes representatives from the ministries of Emergency and Disaster Management, Public Works and Housing, Local Administration and Environment, and Economy and Industry, in addition to representatives from the Syrian Engineers Syndicate, the universities of Homs and Lattakia, and the Syrian Arab Organisation for Standardization and Metrology, which is affiliated with the Ministry of Economy and Industry and is responsible for preparing and approving national standard specifications for products and materials, including building materials. It is unclear why representatives of these two universities and not other ones were appointed.

During the meeting, the committee discussed the mechanism for preparing the new code, including reviewing Arab and international codes adopted in the field of construction in order to benefit from comparative experiences in establishing safety and construction standards. Work is also underway to form specialised technical committees in areas such as structural engineering systems and fire prevention. These committees will prepare the initial draft of the Syrian National Code, including the technical conditions and standards related to the safety of buildings and facilities.

The draft law will in turn undergo legal review to ensure its compatibility with existing laws and legislation before being presented to the public bodies concerned with construction and urban planning in order to provide comments and proposals. In the final stage, the code is expected to be issued and subsequently subject to periodic review in line with technological developments in the construction sector. The law will also require those wishing to build to apply the structural safety standards stipulated by the code.

During the meeting, the Minister of Emergency and Disaster Management Raed Al-Saleh said that there are shortcomings in updating the old code, considering that the country lacks a clear and comprehensive code related to safety, security, and protection from fires and natural disasters, the consequences of which became clearly evident after the February 2023 earthquake. Mr Saleh indicated that the need for a new national code is increasing with the expected urban expansion in the country, including residential tower projects and large urban developments, which requires modern structural standards that keep pace with global developments in the field of construction. He also stressed the importance of the role of the Syrian Engineers Syndicate in monitoring the application of the code’s standards on the ground.

Mr Saleh indicated that the problem is not limited only to updating the code, but also includes weak compliance with safety standards in a large number of residential buildings and industrial and tourist facilities. He cited the example of a warehouse in the Idlib countryside that was exposed to a fire in February which civil defence teams were unable to contain because there was no emergency exit, leading to major losses for its owner. He also referred to the collapse of a four-storey building in the Ashrafiyeh neighbourhood of the city of Aleppo on March 7 as a result of weak foundations and columns, which made it difficult for civil defence teams to remove the rubble and rescue the victims, resulting in ten deaths.

عودة النازحين السوريين من لبنان تتسارع مع تصاعد الحرب في المنطقة وتكشف أزمة السكن في مناطقهم الأصلية

تزايدت حركة عودة السوريين المقيمين في لبنان إلى سوريا خلال الأيام الماضية، مع تصاعد القصف الإسرائيلي على مناطق واسعة في لبنان وامتداده إلى الضاحية الجنوبية في بيروت. وتتزامن هذه التطورات مع آثار مباشرة للحرب الإقليمية على الداخل السوري، إذ تسببت صواريخ ومسيرات إيرانية اعترضتها إسرائيل في الأجواء السورية بأضرار في أبنية سكنية في محافظات مختلفة، ما أضاف ضغوطاً جديدة على واقع السكن.

استجابة الحكومة الانتقالية للعائدين على الحدود

معاون وزير الطوارئ وإدارة الكوارث أحمد أقزيز، قال لسيريا ريبورت، إن الحرب في لبنان دفعت نحو 90,000 نازح سوري في لبنان، حتى 11 آذار، إلى العودة بشكل مفاجئ إلى سوريا هرباً من اتساع نطاق العمليات العسكرية. وأضاف أن الحكومة الانتقالية لم تُنشئ حتى الآن أي مراكز إيواء مخصصة لاستقبال العائدين لأن “معظم العائدين فضلوا التوجه مباشرة إلى مناطقهم الأصلية”.

وأشار أقزيز إلى أن الإجراءات التي تنفذها الجهات الحكومية حالياً تتركز على تقديم مساعدات إغاثية أولية للعائدين خلال انتظارهم على المعابر الحدودية، إضافة إلى تأمين وسائل نقل للأشخاص الذين يرغبون في العودة إلى مناطق بعيدة داخل سوريا ولا يملكون وسائل نقل، مثل مناطق في ريف حلب أو المناطق الشرقية.

وأوضح أيضاً أن وزارة الطوارئ وإدارة الكوارث شكلت غرفة عمليات للاستجابة السريعة، تتولى التنسيق بين الجهات الحكومية المعنية بهذا الملف، ومنها وزارة الخارجية والمغتربين ووزارة الشؤون الاجتماعية والعمل، إضافة إلى التنسيق مع المنظمات الدولية، بهدف تنظيم الاستجابة للعائدين وتأمين الاحتياجات الأساسية لهم خلال عبورهم الحدود وفي مراحل عودتهم الأولى.

تشير تقديرات لهيئة المنافذ البرية والبحرية، اطلعت سيريا ريبورت عليها، إلى أن معظم العائدين من لبنان دخلوا إلى سوريا عبر ثلاثة معابر حدودية رئيسية هي معبر جديدة يابوس في ريف دمشق، ومعبر جوسية في ريف حمص من جهة القصير، ومعبر العريضة في محافظة طرطوس. شهدت هذه المعابر ازدحاماً واضحاً خلال الأيام الأولى من تصاعد العمليات العسكرية في لبنان، مع تزايد أعداد السوريين الذين قرروا العودة بشكل سريع خوفاً من توسع نطاق الحرب.

وتختلف مناطق عودة السوريين القادمين من لبنان بحسب أماكن سكنهم الأصلية داخل سوريا. إذ عاد قسم كبير منهم إلى مناطق القلمون وريف دمشق، إضافة إلى مناطق في محافظة حمص وريفها، فيما يتجه آخرون إلى مناطق أبعد مثل ريف حلب أو المحافظات الشرقية. ويؤدي هذا التوزع الجغرافي إلى تفاوت في احتياجات العائدين، خصوصاً في ما يتعلق بالسكن وإمكانية العودة إلى المنازل الأصلية.

خيارات السكن المؤقت للعائدين في ظل تضرر منازلهم

وتتم هذه العودة في ظروف معيشية معقدة، إذ إن عدداً كبيراً من العائدين ينحدر من مناطق سورية تعرضت لدمار واسع خلال سنوات النزاع منذ العام 2011. لذلك يجد كثير منهم أنفسهم أمام منازل متضررة تحتاج إلى أعمال ترميم، أو مبانٍ مدمرة بالكامل تتطلب إعادة بناء، ما يفرض على جزء من العائدين الإقامة في تلك المنازل المتضررة أو اللجوء مؤقتاً إلى أقاربهم أو إلى الاستئجار ريثما يتمكنون من إصلاح منازلهم.

وبحسب أقزيز، فإن الغالبية العظمى من العائدين فضلت العودة إلى مناطقها الأصلية والإقامة في منازلها، التي بعضها متضرر جزئياً. وقدّر أقزيز، نسبة أولئك بنحو 80 بالمئة من مجموع العائدين. في المقابل، اختار نحو 20 بالمئة من العائدين الإقامة مؤقتاً لدى أقاربهم أو استئجار منازل إلى حين تمكنهم من ترميم مساكنهم والعودة إليها.

قدرة العائدين على ترميم مساكنهم تبقى محدودة في كثير من الحالات، بسبب ارتفاع تكاليف مواد البناء وضعف الموارد المالية بعد سنوات من النزوح. لذلك قد يعتمد البعض على مساعدة منظمات دولية أو محلية، سواء على شكل مواد لترميم المنازل أو دعم نقدي محدود يساعد على إصلاح الأضرار الجزئية في المساكن.

كما يواجه بعض العائدين صعوبات إضافية تتعلق بغياب الخدمات الأساسية في مناطقهم، مثل الكهرباء والمياه وشبكات الصرف الصحي، وهي عوامل تؤثر على إمكانية استقرارهم في تلك المناطق. في بعض الحالات يختار العائدون البقاء مؤقتاً في مناطق قريبة من أماكنهم الأصلية ريثما تتحسن ظروف السكن والخدمات.

أضرار سكنية في سوريا نتيجة سقوط شظايا الصواريخ

تسببت الصواريخ والدرونات الإيرانية التي اعترضتها إسرائيل في الأجواء السورية بسقوط عدد منها أو شظاياها على مناطق سكنية في سوريا، ما أدى إلى أضرار مباشرة في بعض الأبنية ووقوع ضحايا. في مدينة السويداء، تسبب صاروخ سقط على عمارة سكنية في مطلع آذار، بتدمير الطوابق الأرضية ومقتل خمسة أشخاص بينهم طفلان. وفي مدينة عين ترما في الغوطة الشرقية بريف دمشق، أدى سقوط شظايا صاروخ في أول آذار إلى تدمير منزل بشكل كامل ووقوع 4 إصابات، إضافة إلى تضرر بعض المنازل المجاورة. وفي محافظة درعا تعرضت بعض المنازل لأضرار متفاوتة، بينها منازل في مدينة جاسم تضررت نتيجة سقوط مسيرة وانفجارها مباشرة فوق أحد المنازل، ما أدى إلى تدميره ووقوع ضحايا، إضافة إلى أضرار في المنازل المحيطة. كما سقطت صواريخ أخرى في مناطق زراعية مفتوحة، منها الأراضي الواقعة بين بلدتي كفرزيتا واللطامنة في ريف حماة، وكذلك في بلدة عقيربات.

Syrians Fleeing Lebanon War Face Housing Crisis at Home

An increasing number of Syrians residing in Lebanon have returned in recent days alongside escalating Israeli bombardment across wide areas of Lebanon, including the southern suburbs of Beirut. Many of the returnees are going back to damaged homes that require renovation work, or buildings that have been completely destroyed and require rebuilding.

These developments coincide with direct effects of the regional war on Syria itself, as Iranian missiles and drones intercepted by Israel in Syrian airspace caused damage to residential buildings in various governorates.

The transitional government’s response to returnees

Deputy Minister of Emergency and Disaster Management Ahmad Aqziz told The Syria Report that, as of March 11, the war in Lebanon pushed about 90,000 Syrians in Lebanon to return suddenly to Syria in order to escape the widening scope of military operations. He added that the transitional government has not yet established any shelters designated for receiving returnees because “most returnees preferred to head directly to their original areas.”

Mr Aqziz said they are providing initial relief to returnees while they wait at border crossings, and securing transport for people who wish to return to distant areas inside Syria but do not have a way to get there, such as areas in the Aleppo countryside or the eastern regions.

The Ministry of Emergency and Disaster Management has formed an operations room for rapid response, which coordinates between the government bodies concerned with this issue, including the Ministry of Foreign Affairs and Expatriates and the Ministry of Social Affairs and Labour, in addition to coordination with international organisations, he added. The aim is to organise the response to returnees and secure their basic needs during their border crossing and in the early stages of their return.

Patterns of return

Most returnees from Lebanon entered Syria through three main border crossings: the Jdeidet Yabous crossing in the Damascus countryside, the Jousieh crossing in the Homs countryside near Al-Qusayr, and the Arida crossing in the Tartous governorate, according to data by the General Authority for Borders and Customs. These crossings witnessed clear congestion during the first days of the escalation in Lebanon, with increasing numbers of Syrians deciding to return quickly for fear of the war expanding.

A large number returned to the Qalamoun region and the Damascus countryside, in addition to areas in Homs governorate and its countryside, while others are heading to more distant areas such as the Aleppo countryside or the eastern governorates. This geographical distribution leads to differences in the needs of returnees, particularly regarding housing and the possibility of returning to their original homes.

Temporary housing options and damage to homes

This mass return movement is taking place under complex living conditions, as a large number of returnees originate from areas within Syria that experienced widespread destruction during the years of war since 2011. Many of them return only to find damaged homes that require renovation work, or buildings that have been completely destroyed and require rebuilding. This forces some returnees either to stay in those damaged homes or to temporarily rely on relatives or rental housing until they are able to repair their homes.

According to Mr Aqziz, around 80 percent of returnees preferred to return to their original areas and stay in their homes, some of which are partially damaged. In contrast, around 20 per cent of returnees chose to stay temporarily with relatives or rent homes until they are able to repair their houses.

The ability of returnees to repair their homes remains limited in many cases due to the high cost of building materials and weak financial resources after years of displacement. Some may therefore rely on assistance from international or local organisations, whether in the form of materials for repairing homes or limited cash support to help fix partial damage to housing.

Some returnees also face additional difficulties related to the absence of basic services in their areas, such as electricity, water, and sewage networks, factors that affect their ability to settle in those areas. In some cases, returnees choose to remain temporarily in areas close to their original homes until housing conditions and services improve.

Housing damage due to falling missile debris

Iranian missiles and drones intercepted by Israel in Syrian airspace caused some of them or their fragments to fall onto residential areas in Syria, leading to direct damage to some buildings and casualties. 

In the city of Suweida, a missile that fell on a residential building in early March destroyed the ground floors and killed five people, including two children. In the town of Ain Terma in the East Ghouta area of Rural Damascus, falling missile fragments on March 1 completely destroyed a house and caused four injuries, in addition to damage to some neighbouring homes. In the Daraa governorate, some houses sustained varying levels of damage, including houses in the city of Jasim that were damaged when a drone fell and exploded directly above one of them, leading to destruction and injuries, in addition to damaging surrounding homes. Other missiles also fell in open agricultural areas, including land located between the towns of Kafr Zita and Al-Latamneh in the Hama countryside, as well as in the town of Uqayribat.

وزارة الإدارة المحلية تبدأ مسحاً وطنياً لأضرار المساكن وأول الأرقام تصدر من درعا

بدأت وزارة الإدارة المحلية والبيئة عملية مسح للأضرار التي تعرضت لها المساكن خلال سنوات الحرب في سوريا، بالتعاون مع برنامج الأمم المتحدة للمستوطنات البشرية UN-Habitat، بهدف إنتاج قاعدة بيانات رسمية موحدة حول حجم الأضرار في المساكن. وقد بدأت العملية من محافظة درعا في شباط 2026، على أن تتوسع لاحقاً لتشمل بقية المحافظات.

وكانت الوزارة قد خططت لهذا المسح منذ أيلول 2025، بمساعدة خبراء من برنامج الأمم المتحدة للمستوطنات البشرية. وستقوم لجان فنية متخصصة تابعة للوحدات الإدارية في كل محافظة بتنفيذ مسح ميداني للأضرار في المساكن ضمن نطاق كل وحدة إدارية، قبل رفع تقاريرها إلى المحافظة، حيث تُجمع البيانات وتُرسل لاحقاً إلى الوزارة.

وأوضح مدير العلاقات العامة في وزارة الإدارة المحلية علي الحمد لسيريا ريبورت أن الوزارة تتوقع الانتهاء من عملية المسح خلال شهرين، ما سيوفر بيانات رسمية واضحة حول عدد المساكن المتضررة ونسب الأضرار فيها. كما أشار إلى أن سرعة إنجاز المسح قد تختلف بين المحافظات، إذ تحتاج المحافظات ذات المساحة الجغرافية الأكبر إلى وقت أطول لإتمام أعمال اللجان الفنية.

وبحسب بيانات نشرتها وزارة الإدارة المحلية في صفحتها الرسمية على فيسبوك، فإن أعمال المسح الجارية في درعا توصلت إلى أن عدد المساكن المتضررة في عموم المحافظة يبلغ نحو 93 ألف منزل، منها 33,400 متضررة بالكامل وتحتاج إلى إعادة بناء، في حين أن نحو 60 ألف منزل تعرضت لأضرار متفاوتة يمكن العمل على ترميمها بدرجات مختلفة.

ولم تفصل الوزارة في بياناتها الرسمية توزيع الأضرار بين مناطق المحافظة المختلفة. إلا أن مراسل سيريا ريبورت أفاد بأن أكثر المناطق تضرراً هي درعا البلد، حيث قُدرت نسبة الأضرار في المساكن بنحو 70 بالمئة، تليها بلدة الشيخ مسكين في ريف درعا بنسبة تقارب 60 بالمئة، ثم بصرى الحرير بنسبة تصل إلى 50 بالمئة. كما تعد بلدة نامر من المناطق التي بلغت فيها نسبة الأضرار في المساكن نحو 50 بالمئة.

كما أفاد مراسل سيريا ريبورت أن اللجان الفنية التي شكلتها الوحدات الإدارية في محافظة حلب قد قاربت بدورها على الانتهاء من مسح أضرار المساكن في المحافظة، باعتبارها المحافظة الثانية التي يجري فيها تنفيذ هذا المسح بعد درعا. وتعمل اللجان الفنية حالياً على إعداد الأرقام النهائية المتعلقة بعدد المساكن المتضررة، تمهيداً لرفعها إلى وزارة الإدارة المحلية والبيئة ضمن البيانات الإجمالية للمسح.

في المقابل، كانت نقابة المهندسين في سوريا قد أعدت في العام 2025 دليلاً إجرائياً لمسح الأضرار في المساكن. وقال أمين سر النقابة رصين عصمت لسيريا ريبورت إن هذا الدليل وُضع وفق معايير عالمية، ليكون المرجع الذي تعتمد عليه الفرق الفنية في تحديد نسب الأضرار في العقارات السكنية.

وأوضح عصمت أن الدليل يحدد معايير تصنيف الأضرار في المساكن، بما في ذلك المساكن غير القابلة للترميم والتي تحتاج إلى إعادة بناء. وتشمل هذه الفئة المساكن التي تضررت جملتها الإنشائية، حتى لو كانت ما تزال قائمة لكنها أصبحت خطرة. وبناءً على ذلك تُصنَّف هذه المساكن ضمن فئة المساكن المدمرة، وهو ما يسمح بالتمييز بين المساكن المدمرة وتلك التي تعرضت لأضرار متفاوتة يمكن ترميمها.

وقال مصدر في وزارة الإدارة المحلية لسيريا ريبورت إن توحيد أرقام الأضرار عبر هذا المسح سيجعلها المرجع الرسمي بدلاً من التقديرات المتفرقة التي تصدر عن جهات مختلفة. ويفترض أن تتيح هذه البيانات الرسمية للجهات العامة والشركات الخاصة التي ترغب بالدخول في مشاريع إعادة الإعمار والتطوير العقاري الاعتماد على أرقام دقيقة عند تقدير كلفة إعادة إعمار المناطق المتضررة. كما يُفترض أن يساهم توفر هذه البيانات في تسريع إعداد الدراسات والمشاريع المرتبطة بإعادة الإعمار.

National Housing Damage Survey Begins, First Figures Emerge from Daraa

The Ministry of Local Administration and Environment has begun  surveying damage sustained by housing during the war in Syria, in cooperation with the United Nations Human Settlements Programme UN-Habitat. The survey aims to produce a unified official database on the scale of housing damage. The process began in Daraa Governorate in February 2026 and will later expand to include the remaining governorates.

The ministry had planned this survey since September 2025, with assistance from UN-Habitat experts. Specialised technical committees affiliated with the administrative units in each governorate will carry out field surveys of housing damage within the scope of each administrative unit, before submitting their reports to the governorate, where the data will be compiled and later sent to the ministry.

Ali Al-Hamad, a spokesperson for the Ministry of Local Administration and Environment, told The Syria Report that the ministry expects to complete the survey within two months, and added that the speed of completing the survey may vary between governorates, as those with larger geographical areas will require more time for the technical committees to complete their work.

The survey in Daraa governorate has found about 93,000 damaged homes; 33,400 are completely destroyed and require reconstruction, while around 60,000 houses have varying levels of damage that can be repaired to different degrees.

The most affected area is Daraa Al-Balad, in Daraa city, where housing damage is estimated at around 70 per cent, followed by the town of Sheikh Miskin in the Daraa countryside at approximately 60 per cent, then Busra Al-Harir at up to 50 per cent. The town of Namer is also among the areas where housing damage has reached about 50 per cent.

The technical committees formed by the administrative units (towns and villages) in Aleppo have also nearly completed the survey of housing damage in that governorate. The technical committees are currently preparing the final figures related to the number of damaged homes, in preparation for submitting them to the Ministry of Local Administration and Environment as part of the overall survey data.

In 2025, the Syrian Engineers Syndicate prepared a procedural guide for surveying housing damage. The Syndicate’s Secretary, Rasheen Ismat, told The Syria Report that this guide was developed according to international standards, so that it could serve as the reference used by technical teams in determining the level of damage to residential properties.

Mr Ismat explained that the guide sets out the criteria for classifying housing damage, including homes that cannot be repaired and require reconstruction. This category includes homes whose structural integrity has been damaged, even if they are still standing but have become dangerous.

A source in the Ministry of Local Administration and Environment told The Syria Report that unifying damage figures through this survey will make them the official reference instead of the scattered estimates issued by different entities. These official data are expected to enable public bodies and private companies wishing to enter reconstruction and real estate development projects to rely on accurate figures when estimating the cost of rebuilding damaged areas. The availability of these data is also expected to contribute to accelerating the preparation of studies and projects related to reconstruction.

تهجير وغصب عقارات يلاحق شيعة حمص

دخلت معاناة عدد كبير من أبناء الطائفة الشيعية في محافظة حمص وريفها عامها الثاني، بعد سلسلة من الانتهاكات التي طالت ملكياتهم العقارية ومجتمعاتهم، في سياق التحولات التي أعقبت 8 ديسمبر 2024. ويظهر من مجمل الوقائع التي يستعرضها هذا المقال، أن المسألة اتخذت طابعاً يمس حق السكن وحق الملكية، ضمن سياق عدالة محلي ما زالت آلياته القانونية والمؤسساتية غير مستقرة. ويضع ذلك المتضررين أمام خيارات محدودة بين النزوح المؤقت أو الدائم، أو الدخول في مسارات قضائية غير مضمونة النتائج.

وتوزعت هذه الوقائع جغرافياً بين بضعة قرى في ريف حمص أبرزها قريتي الغور وأم العمد، إضافة إلى حيّ العباسية داخل مدينة حمص. بعض القرى شهدت تهجيراً لسكانها من أبناء الطائفة الشيعية، سواء نتيجة هجمات مباشرة، أو بسبب ضغوط وتهديدات متكررة، ما أدى إلى انتقال قسم منهم إلى مناطق أخرى داخل سوريا، بينما اتجه قسم آخر إلى لبنان خلال الأشهر الأولى التي أعقبت سقوط النظام، ولا يزال جزء كبير منهم خارج مناطقهم حتى الآن.

منذ الأيام الأولى لسقوط نظام الأسد، ظهرت أنماط متعددة من الضغوط والانتهاكات، بعضها جاء بذريعة ملاحقة فلول النظام، وبعضها الآخر ارتبط باستغلال حالة اضطراب موازين القوى على الأرض وغياب الدور الفعّال للمؤسسات والقوى الأمنية. وتتداول بعض الأوساط السنيّة التي كانت محسوبة على المعارضة السورية، رواية تربط بين الطائفة الشيعية وانخراطها في صفوف قوات نظام الأسد وتشكيلات مدعومة من حزب الله اللبناني، وهو خطاب يُستحضر في سياق تبرير بعض هذه الانتهاكات.

لكن، لم تقتصر الانتهاكات على ملاحقة أشخاص ذوي صلة سابقة بأجهزة عسكرية أو أمنية، بل طالت مدنيين لم ينخرطوا في أي نشاط ضد المعارضة السورية. وتراوحت هذه الوقائع بين التدمير المباشر للمنازل، والاستيلاء على العقارات، والتهديد أو الابتزاز.

في قرية الغور في ريف حمص الشمالي، تحوّل القصف بالدبابات إلى مسار تهجير لسكانها من أبناء الطائفة الشيعية. يروي فراس 52 عاماً، لسيريا ريبورت، كيف تحوّل منزله إلى حطام خلال يناير 2025، بعدما دخلت أرتال الأمن العام السوري إلى القرية بذريعة ملاحقة فلول نظام الأسد. وبحسب روايته، لم تقتصر العملية على ملاحقات أمنية محددة، بل شملت مداهمة منازل وقصف أخرى بالدبابات، وإطلاق هتافات طائفية، وترويع السكان. وتحت وطأة أصوات الرصاص، خرج فراس وعائلته من منزلهم إلى منزل شقيقه المجاور، قبل أن يتم اقتياده مع شقيقه وابن شقيقه إلى ساحة في القرية، حيث تعرضوا للضرب مع عدد من شبان القرية، قبل الإفراج عنهم.

ويقول فراس إن قادة الأرتال وجّهوا بتدمير المنازل الفارغة من سكانها، وهو ما أدى إلى استهداف منزله مباشرة بعد خروجه منه. ويصف لحظة رؤيته المنزل مدمراً بأنها كانت أقسى من الهجوم نفسه، معتبراً أن فقدان مسكنه أشبه باقتلاع لذاكرة عائلته وهوية ارتبطت بالمكان على مدى سنوات من الترميم والتوسعة.

يشير مراسل سيريا ريبورت إلى أن غالبية من سكان القرية غادروها في ذلك اليوم، ورغم أن جزءاً منهم عاد لاحقاً، فما زال القسم الأكبر خارجها حتى الآن. ويقيم فراس اليوم في لبنان مع عائلته في منزل صغير، ويعمل في أحد أفران الصمون، مؤكداً أنه لا يملك ما يكفي لإعادة ترميم منزله. تعكس حالة قرية الغور نمطاً من التدمير المباشر للأملاك باعتباره وسيلة ضغط جماعي، تتجاوز الملاحقة الفردية، ما يجعل العودة مشروطة بإعادة البناء والترميم المكلفة، والتي لا تتوافر إمكاناتها لمعظم المتضررين.

مسار التهجير لم يقتصر على الحملات الأمنية أو التدمير المباشر، بل برز نمط آخر تمثل في الاستيلاء على المنازل الخالية، من دون عمليات عسكرية أو قرارات رسمية. تعكس هذه الحالة نمطاً من وضع اليد على العقارات الخالية يستند إلى واقع القوة المستجد على الأرض.

في قرية أم العمد في ريف حمص الشرقي، التابعة إدارياً لمدينة المخرم الفوقاني، يروي علي، وهو شاب في الثلاثينيات من عمره، كيف تحوّل منزله الموروث عن والده إلى سكن لعائلة من عشائر بدوية تقطن في جوار القرية. يقول علي إنه كان يقيم في محافظة دمشق بحثاً عن فرصة أفضل لكسب العيش، قبل أن يتفاجأ بإبلاغه من أحد معارفه في القرية بأن منزله بات مشغولاً. وبحسب روايته، فقد جاء في سياق استغلال اضطراب الموازين على الأرض بعد سقوط النظام، حيث بادر أحدهم إلى إشغال المنزل من دون أي مبرر قانوني. ويسود هذا النهج ذاته في بعض القرى العلوية في ريف اللاذقية، حيث استوطنت عشائر بدوية فيها، وطردت سكانها، وغصبت جزءاً من مساكنها. ويعود ذلك نسبياً إلى شعور بعض العشائر البدوية بالحصانة نتيجة تسامح الإدارة الانتقالية مع مسالكها في ظل اعتمادها عليها في العمليات العسكرية.

ويضيف علي أن صديقه توجه إلى الشخص الذي شغل المنزل وأبلغه بأن له أصحاباً يقيمون في محافظة أخرى، إلا أن الأخير ردّ بأن ذلك لا يعنيه، متهكماً بأن المنزل الفارغ هو لمن يسكنه، ومشيراً إلى أن على صاحبه “أن يحمد الله لأنه لم يُهجَّر هو أيضاً بسبب كونه شيعياً”. وأمام فشل المساعي الودية، قرر علي في أكتوبر 2025 رفع دعوى غصب عقار، بعد سلسلة من الاتصالات لمحاولة تسوية الأمر. وكلّف محامياً لمتابعة القضية أمام القضاء، وهو بانتظار مجريات الدعوى.

الأمر لا يتعلق دوماً بالمساكن الشاغرة. في حي العباسية داخل مدينة حمص، ذي الغالبية الشيعية، يروي سامر 41 عاماً، وهو موظف حكومي، تفاصيل إخلاء عائلته في نهاية أيلول 2025 من المنزل الذي اشتراه قبل نحو 7 أعوام. ويقول إن أحد أفراد عشائر البدو اقتحم منزله مع بداية العام الدراسي، وأجبره وعائلته على المغادرة، من دون السماح لهم بإخراج مقتنياتهم، بما في ذلك الكتب المدرسية لأطفاله.

ويضيف أنه عندما حاول الاعتراض، وضع الرجل مسدساً في رأسه، ما اضطره إلى مغادرة المنزل خلال 24 ساعة، من دون أن يتمكن من نقل أي قطعة أثاث تخفف عنه عبء السكن في مكان آخر. ويصف سامر ما جرى بأنه إخلاء قسري تحت تهديد السلاح، في ظل غياب أي جهة قادرة على التدخل الفوري لوقف التعدي.

سلك سامر مساراً قانونياً عبر مراجعة لجنة الغصب البيّن التابعة لمحافظة حمص، إلا أن الموظف هناك أبلغه بأن اللجنة لا تستطيع التدخل في “هذه النزاعات الحساسة” في المرحلة الحالية. ومع شعوره بانعدام الحماية، انتقل سامر مع عائلته إلى دمشق، تخوفاً من أي استهداف إضافي في محافظة يرى أن الدور الفعلي لمؤسساتها الأمنية لا يزال غائباً. وفي ديسمبر 2025، حاول سامر التواصل مجدداً مع من استولى على منزله بغية التوصل إلى تسوية، غير أن الأخير طلب مبلغ 5,000 دولار أميركي مقابل إخلاء المنزل وإعادته، ما وضعه أمام خيارين، إما الاستدانة لاستعادة ملكه، أو البقاء مهجراً بانتظار مسار قضائي قد يطول.

محامٍ من مدينة حمص، رفض ذكر اسمه، قال لمراسل سيريا ريبورت، أن المادة 723 من قانون العقوبات السوري تجرّم غصب العقارات. وتنص المادة على معاقبة كل من استولى على عقار أو جزء منه من دون سند رسمي بالملكية أو حق التصرف، وكان العقار بيد غيره، بالحبس لمدة تصل إلى 6 أشهر، وتشدد العقوبة إذا اقترن الفعل بالتهديد أو استخدام القوة. أما إذا ارتكب الفعل عدد من المسلحين، فقد تصل العقوبة إلى 3 سنوات.

وفي ما يتعلق بهدم الممتلكات، يشير إلى أن المادة 718 من القانون ذاته تنص على الحبس من 3 أشهر إلى سنتين، إضافة إلى غرامة مالية لا تتجاوز 200 ليرة. ويصف المحامي هذه العقوبة بأنها لا تقارن بحجم الضرر، لافتاً إلى مفارقة أن بعض حالات تدمير المنازل، بحسب شهادات واردة في هذا المقال، نُسبت إلى قوات الأمن العام، وهي الجهة المفترض بها حماية القانون.

ويضيف المحامي أنه تلقى عدداً من دعاوى الابتزاز المالي المرتبط بغصب العقارات في حمص، موضحاً أن عقوبات الابتزاز قد تصل إلى الأشغال الشاقة المؤقتة وفق توصيف الفعل. غير أن بطء الإجراءات وتراخي التطبيق العملي، بحسب رأيه، يحوّلان بعض هذه الدعاوى إلى مسارات تستفيد منها الجهة المعتدية أكثر مما تنصف أصحاب الحقوق.

وينتقد المحامي غياب الدور الفاعل للجنة الغصب البيّن في حمص في استعادة الأملاك التي تم الاستيلاء عليها بعد 8 ديسمبر 2024، معتبراً أن تعطّل هذا المسار ينعكس خللاً في حماية حق السكن ويؤشر إلى تصدّع في العقد الاجتماعي بين مكونات المحافظة. ويشير إلى أن غالبية حالات غصب العقار المسجلة منذ ذلك التاريخ طالت الأقليات الشيعية والعلوية، فيما كانت الحالات قبل ذلك التاريخ تمس في معظمها أبناء الطائفة السنية، مع عدد محدود من الحالات في أوساط مسيحية في منطقة الحميدية. ويرى أن هذا التحول في أنماط الاستهداف يطرح تساؤلات حول أثر الانتماء الطائفي في النزاعات العقارية الجارية، في ظل بيئة يغيب فيها الردع الفعلي.

تعديل مرتقب للقانون المالي للوحدات الإدارية: نحو إعادة تنظيم الرسوم العقارية وحصص الضرائب

تعمل حالياً وزارة الإدارة المحلية والبيئة على تعديل القانون المالي للوحدات الإدارية رقم 37 لعام 2021، في خطوة تعيد فتح ملف الرسوم والضرائب التي تستوفيها الوحدات الإدارية، ومنها تلك المرتبطة بالعقارات.

وعلمت سيريا ريبورت أن وزارة الإدارة المحلية والبيئة، شكّلت مطلع العام الحالي لجنة خاصة لدراسة التعديلات المقترحة على القانون المالي للوحدات الإدارية رقم 37 لعام 2021. عقدت اللجنة اجتماعها الأول في 22 شباط 2026، في جلسة وُصفت بأنها تأسيسية للبدء بمراجعة مواد القانون.

وبحسب ما علمته “سيريا ريبورت”، يرأس اللجنة معاون وزير الإدارة المحلية للشؤون الفنية، وتضم في عضويتها ممثلين عن وزارة المالية، والهيئة العامة للضرائب والرسوم، والجهاز المركزي للرقابة المالية، إضافة إلى عضو قانوني، وممثل عن مديرية المالية في الوزارة، وعضو فني. كما تضم ثلاثة أعضاء يمثلون الوحدات الإدارية، جرى اختيارهم بالتنسيق مع هذه الوحدات، نظراً لعدم إمكانية تمثيل كل وحدة إدارية بعضو مستقل في اللجنة.

وقال مدير العلاقات العامة في وزارة الإدارة المحلية علي الحمد لـ”سيريا ريبورت”، إن اللجنة مُنحت مهلة 3 أشهر لإنجاز مقترحات التعديل، وإن اجتماعها الأول كان اجتماعاً تأسيسياً للبدء بمراجعة مواد القانون الحالي. وأضاف أن الحديث عن طبيعة التعديلات لا يزال مبكراً، لأن اللجنة في بداية عملها، إلا أن الهدف هو إعادة النظر في بعض الضرائب وتنظيمها ضمن إطار تشريعي أكثر وضوحاً.

وينظم القانون رقم 37 لعام 2021، وتعليماته التنفيذية، الموارد المالية للوحدات الإدارية، في إطار قانون الإدارة المحلية رقم 107 لعام 2011. وتشمل الوحدات الإدارية المحافظة والمدينة والبلدة والبلدية، وتُمنح صلاحية استيفاء رسوم وضرائب لقاء خدمات تقدمها أو رخص تمنحها ضمن حدودها الإدارية. ويُميز القانون بين نوعين من الموارد. الأول رسوم مباشرة تستوفيها الوحدة الإدارية لقاء خدمات محددة، مثل شق الطرقات وتزفيتها وإنارتها ومنح رخص البناء. أما الثاني فهو موارد غير مباشرة، تتمثل بحصص تُحوّل إلى الوحدات الإدارية مما تجبيه الجهات العامة من ضرائب ورسوم، ومنها ضرائب ريع العقارات وضرائب العرصات. وبموجب القانون 37، تحصل الوحدات الإدارية على نسبة 10 بالمئة من ضرائب ريع العقارات والعرصات التي تجبيها دوائر المالية في وزارة المالية، كما توزع الرسوم المضافة المحصلة على مستوى سورية بين الوحدات الإدارية وفق نسب حددها القانون نفسه.

وكان القانون رقم 37 لعام 2021 قد أدخل تعديلاً جوهرياً على بعض الرسوم ذات الطبيعة العقارية، من خلال ربطها بالقيم الرائجة للعقارات بدلاً من القيم التخمينية الثابتة. وبموجب القانون، تُستوفى نسبة مئوية من القيمة الرائجة للعقار عند منح رخصة البناء أو عند إعادة البناء أو إحداث إضافات جديدة، على أن تحدد التعليمات التنفيذية تفاصيل احتساب هذه الرسوم وعناصرها. كما استُعملت القيمة الرائجة أساساً لتحديد رسم مقابل التحسين الناتج عن أعمال المنفعة العامة، الذي يُفرض على مالكي العقارات المبنية وغير المبنية والسطوح والأراضي التي يطرأ عليها تحسن نتيجة أعمال المنفعة العامة. وتتولى كل وحدة إدارية ضمن حدودها تحديد المناطق التي يطرأ عليها التحسين واستيفاء الرسم من المكلفين، وفق آلية نص عليها القانون والتعليمات التنفيذية، مع منح أصحاب العلاقة حق الاعتراض والطعن وفق الأصول المحددة.

قال مدير العلاقات العامة في وزارة الإدارة المحلية علي الحمد لـ”سيريا ريبورت” إن الهدف من التعديل هو إعادة تنظيم بعض الضرائب التي وصفها بأنها “عشوائية”، من دون الدخول في تفاصيل إضافية حول طبيعة المواد التي ستطالها المراجعة، مشيراً إلى أن الوزارة تسعى إلى تطوير بنيتها التشريعية وتعديل ما يلزم من الصكوك القانونية المرتبطة بعملها، بما في ذلك ما يتصل بالتنظيم العمراني. وأضاف الحمد أن الوزارة ستتواصل مع مختلف الوحدات الإدارية خلال فترة عمل اللجنة، من أجل الخروج بصيغة قانونية تتناسب مع المرحلة الحالية، مؤكداً أن مهلة 3 أشهر كافية لدراسة مواد القانون واقتراح التعديلات اللازمة.

يثير مسار التعديل المرتقب مسألة آلية تدفق الإيرادات بين الوحدات الإدارية والمحافظات والخزينة العامة. فبموجب القانون رقم 37 لعام 2021، تستوفي الوحدات الإدارية الرسوم المباشرة ضمن حدودها، بينما تُحوَّل إليها حصص من الرسوم والضرائب التي تجبيها الجهات العامة، ومنها ضرائب ريع العقارات والعرصات. تمر بعض هذه الموارد عبر المحافظات ضمن آلية إعداد الموازنات العامة قبل إعادة تخصيصها للوحدات الإدارية، ما يجعل الاستفادة الفعلية من الإيرادات مرتبطة بآليات التخصيص والإنفاق العام. ويضع ذلك مسألة استقلالية الوحدات الإدارية المالية في صلب النقاش حول التعديل، ولا سيما في ما يتعلق بإمكانية تعديل نسب الحصص أو آلية الاحتفاظ بالإيرادات ضمن حدود الوحدة الإدارية نفسها. ولم تصدر حتى الآن أي تفاصيل رسمية حول ما إذا كان التعديل سيطال نسب الحصص المنصوص عليها في القانون، أو سيقتصر على تنظيم الرسوم وآليات احتسابها.

يأتي النقاش حول تعديل القانون المالي للوحدات الإدارية في سياق تجربة تطبيق القانون رقم 37 لعام 2021 خلال السنوات الماضية، ولا سيما بعد ربط عدد من الرسوم بالقيم الرائجة للعقارات. فقد أدى هذا الربط، عند بدء تطبيقه، إلى ارتفاع ملحوظ في رسوم رخص البناء ورسوم التحسين، ما انعكس على كلفة البناء وعلى حركة الترخيص. وتتداخل في هذا النقاش مسألتان أساسيتان. الأولى تقنية تتعلق بطريقة احتساب الرسوم وربطها بالقيم الرائجة. أما الثانية فمالية وإدارية، وترتبط باستقلالية الوحدات الإدارية في إدارة مواردها، وحدود قدرتها على الاحتفاظ بالإيرادات أو الاعتماد على التحويلات ضمن الموازنة العامة.

Displacement and Property Seizure Continue to Affect Shia Residents in Homs

Shia residents in the Homs governorate continue to suffer violations affecting their property and communities following the ouster of the Assad regime in December 2024. 

In a context where legal and institutional mechanisms to achieve justice remain unstable, those affected by housing and property violations face limited options: temporary or permanent displacement, or entering legal paths with uncertain outcomes.

Property violations have been documented in several villages in the Homs countryside, most notably the villages of Al-Ghour and Umm Al-Amad, in addition to the Abbasiya neighbourhood inside the city of Homs. Some villages witnessed the displacement of their Shia residents, whether as a result of direct attacks or due to repeated pressure and threats, leading some to move to other areas inside Syria, while others headed to Lebanon during the first months following the fall of the Assad regime. A large proportion remain displaced to this day.

From the first days following the fall of the Assad regime, multiple patterns of pressure and violations emerged. Some occurred under the pretext of pursuing remnants of the regime, while others were linked to exploiting the changed balance of power on the ground and the absence of an effective role for institutions and security forces. Some Sunni circles previously associated with the Syrian opposition circulated a narrative linking the Shia community to  the Assad regime forces and formations supported by the Lebanese Hezbollah.

However, the violations were not limited to pursuing individuals with previous links to military or security institutions, but also affected civilians who had not engaged in any activity against the Syrian opposition. These incidents ranged from the direct destruction of homes, to the seizure of property, and threats or extortion.

In January 2025,  in the village of Al-Ghour in the northern Homs countryside, tank shelling turned into a path of displacement for its Shia residents. Firas, aged 52, told The Syria Report how his house was reduced to rubble after convoys of  General Security forces entered the village under the pretext of pursuing remnants of the Assad regime. According to his account, the operation not only involved limited security pursuits, but also house raids, tank shelling of other homes, sectarian slogans, and the intimidation of residents. Under the sound of gunfire, Firas and his family left their house for his brother’s nearby home, before he, his brother, and his nephew were taken to a square in the village, where they were beaten alongside a number of young men from the village before being released.

Firas said the convoy commanders ordered the destruction of houses left empty by residents, which led to his house being directly targeted immediately after he left it. He described the moment he saw his home destroyed as harsher than the attack itself, considering the loss of his home akin to uprooting his family’s memory and an identity tied to the house over years of renovation and expansion.

A local correspondent for The Syria Report noted that the majority of the village’s residents left that day, and although some later returned, most remain outside it to this day. Firas now lives in Lebanon with his family in a small house, working at a bakery, adding that he does not possess sufficient means to restore his home. 

The case of Al-Ghour village reflects a pattern of direct property destruction used as a means of collective pressure that goes beyond individual pursuit, making return conditional upon costly reconstruction and renovation beyond the means of most affected people.

Another pattern emerged in the seizure of vacant homes without military operations or official decisions. 

In the village of Umm Al-Amad in the eastern Homs countryside, administratively affiliated with the city of Al-Makhram Al-Fawqani, Ali, a man in his thirties, recounted how the house he inherited from his father was turned into a residence for a family from nearby Bedouin tribes in early 2025. Ali said he had been living in Damascus Governorate in search of a better livelihood before being surprised by a friend informing him that his home was now occupied. According to his account, this occurred in the context of exploiting the unstable balance on the ground after the fall of the regime, when someone took over the house without any legal justification.

The same approach prevails in some Alawite villages in the Lattakia countryside, where Bedouin tribes have settled, expelled residents, and seized parts of their housing. This is partly attributed to a sense of immunity among some Bedouin tribes resulting from the transitional administration’s tolerance of their conduct due to reliance on them in military operations.

Ali added that his friend approached the person occupying the house and informed him that it had owners living in another governorate, but the latter responded that it did not concern him, reportedly saying that an empty house belongs to whoever lives in it, and that its owner “should thank God that he was not also displaced for being Shia”. After friendly efforts failed, Ali decided in October 2025 to file a lawsuit for property usurpation following a series of contacts to settle the matter. He hired a lawyer to pursue the case before the courts and is awaiting its progress.

The issue does not always concern vacant homes. In the Abbasiya neighbourhood inside the city of Homs, which has a Shia majority, Samer, aged 41 and a government employee, recounted the details of his family’s forced eviction at the end of September 2025 from the house he had purchased around seven years earlier. He said that a member of a Bedouin tribe stormed his house at the beginning of the school year and forced him and his family to leave without allowing them to remove their belongings, including his children’s school books.

He adds that when he tried to object, the man placed a pistol to his head, forcing him to leave the house within 24 hours, without being able to move any furniture to ease the burden of housing elsewhere. Samer describes what happened as forced eviction under armed threat, amid the absence of any authority capable of immediate intervention to stop the violation.

Samer pursued a legal route by approaching the Clear Extortion Committee affiliated with Homs Governorate, but the employee there informed him that the committee could not yet intervene in “these sensitive disputes”. Feeling unprotected, Samer moved with his family to Damascus out of fear of further targeting in a governorate where he believes the effective role of its security institutions remains absent. In December 2025, Samer attempted again to contact the person who seized his home in order to reach a settlement, but the latter requested USD 5,000 in exchange for vacating and returning the house, leaving him with two options: to borrow money to recover his property, or remain displaced while awaiting a potentially lengthy legal process.

A lawyer from the city of Homs, who requested anonymity, told The Syria Report that Article 723 of the Syrian Penal Code criminalises property extortion. The article stipulates punishment for anyone who seizes a property or part of it without official ownership documents or the right of disposal, when the property is in another’s possession, with imprisonment of up to six months. There are harsher penalties if the act is accompanied by threats or the use of force. If the act is committed by a number of armed individuals, the penalty may reach three years.

Regarding the demolition of property, the lawyer pointed out that Article 718 of the same law stipulates imprisonment from three months to two years, in addition to a financial fine of up to SYP 200. The lawyer described this punishment as disproportionate to the scale of the harm.

The lawyer added that he has received a number of cases involving financial extortion linked to property extortion in Homs, explaining that extortion penalties may reach temporary hard labour depending on the classification of the act. However, slow procedures and weak practical implementation turn some of these lawsuits into paths that benefit the aggressor more than they deliver justice to rights holders, the lawyer said.

The lawyer also criticised the absence of an effective role by the Clear Extortion Committee in Homs in recovering properties seized after December 8, 2024, considering that the paralysis of this mechanism reflects a failure to protect the right to housing and indicates a fracture in the social contract between the governorate’s communities. Most property extortion cases recorded since that date have affected Shia and Alawite minorities, whereas prior to that date most cases affected members of the Sunni community, with a limited number of cases among Christians in the Al-Hamidiyah area. He said that this shift in patterns of targeting raises questions about the impact of sectarian affiliation on ongoing property disputes in an environment lacking effective deterrence.
